OUR FIGHT AGAINST THE TOWN OF APEX ELECTRICAL OPERATIONS CENTER IS NOT DEAD - Please read on for important updates -
Under the Freedom of Information Act (FOIA), we obtained some documentation from the Town of Apex regarding the town's planning of this project. A reputable law firm has accepted this case based on their review of the situation, documents and their analysis of current zoning laws. This is why we are proceeding. The attorneys will be seeking administrative remedies and legal remedies, such as a temporary restraining order and hopefully an injunction based on the merits of the case.
Without financial support from the community, however, we cannot proceed with legal counsel. PLEASE consider donating to this crucial movement. If every family in our community donates a $100, we can make a difference! But every donation counts, so please give what you can. The future of our neighborhood and our children are at stake!

For those unfamiliar with this project, the Town of Apex wants to place its electrical utility operations center in the middle of thriving residential communities. The project initially includes storage of 30 commercial trucks, a pole barn, a warehouse, hazardous materials and substantial electrical equipment. The increase in commercial truck traffic on our neighborhood roads has enormous potential safety risk for the hundreds of children that live within these communities.

Your support will help to keep the white picket fences of our neighborhood instead of the chain-linked fences and barbed wire of an electric operations facility. We were told the barbed wire fencing is required to prevent the theft of items stored at the facility. Thus inviting a criminal element to our communities. Help us keep out this criminal element!
The current public works facility including the electrical operations is currently located in an area zoned as “office/industrial conditional zoning.” Now they are moving the facility to Rural Residential Conditional Zoning. Your support will help prevent the Town from exceeding its authority in zoning.
Electric operations facilities belong in industrial commercial zones near major roadways. In researching where other electrical facilities are located in North Carolina, we found that they are located in industrial or commercial zones with access to major roadways. Their electric utility trucks do not traverse through residential neighborhoods. In looking at facilities in Durham, South Raleigh, Matthews, Shelby, Monroe, Fuquay-Varina and numerous other locations both here and in the rest of the US, these types of facilities are in industrial or commercial areas.
Residential neighborhoods with lots of children ARE NOT where industrial vehicles belong, such as large bucket trucks and large tractor-trailers coming in with deliveries of large utility poles, transformers and other large equipment used in the electric industry. Your support will protect our children from excessive commercial traffic.
An industrial project of this type does NOT belong in ANY residential neighborhood anywhere. It belongs in an industrial park with major roadways to support the trucks and traffic generated by this type of facility.

Thank you everyone for donating! We still have a long way to go, but the great news is that our initial letter from our attorneys went to the Town of Apex this afternoon. We tried to post the letter from the attorneys but unfortunately, this did not work too well. Please see attached link to access the letter. Please spread the word that we are still fighting the Town regarding this site, and we need more donations to continue moving forward legally to obtain a temporary restraining order as well!
