It all started when CBP Supervisor Timothy Borden said to my Mom, "Shut your mouth, whore, when men are speaking," and it only escalated from there. My Mom suffered daily harassment, discrimination, and retaliation at the hands of her managers. She followed procedure and contacted the Equal Employment Opportunity Commission (EEOC), but despite hundreds of pages of proof in her favor, the EEOC Administrative Judge still ruled against her. She had to act as her own attorney because she did not have the necessary funds to hire one.

To seek justice she must retain an attorney to take her EEO discrimination case to U.S. District Court, with a deadline to file in U.S. District Court by June 29, 2014.

In proving her case of my Mom being subjected to daily harassment and disparate treatment she documented and ultimately has become a whistleblower, revealing not only how CBP, IA, and EEOC all failed to follow, enforce, and rule on law respectively, but also reveals numerous wrongdoings by Federal sworn managerial officers and their subordinates, and CBP failing to serve the public.

First line manager, Supervisory Customs and Border Protection Officer (SCBPO) Timothy Borden beginning in March 2010 began to harass my Mom; "Shut your mouth whore, when men are speaking." and it got worse thereafter with daily berating, hostility, slandering, false claims, and attempts to get her fired.

Second line manager, Port Director (PD) Donna Dedeaux enabled Borden and ultimately joined in singling my Mom out with daily berating and false claims. Dedeaux even altered official documents and submitted them to the EEOC and to CBP Internal Affairs in her attempts to slander my Mom. On one occasion, while my mom was working at the airport she reported a tornado warning and PD Dedeaux instructed my Mom to drive back to the office.

Ultimately a revolving door of managers under fifth line manager, CBP Cleveland, OH Area Port Director (APD) Marc Hurteau continued harassment and disparate treatment towards my Mom through May 2013, only to stop because of my Mom's pleas for Congressional intervention in her attempts to get the harassment to stop.

Senators Rob Portman and Sherrod Brown, and U.S. House of Representatives Bob Latta and Marcy Kaptur provided the U.S. Department of Homeland Security with congressional inquiries on my Mom's behalf. Within approximately 30 hours of their inquiries, the harassment suddenly stopped.

Because of the Agency managers' actions against my Mom, she has accrued over one hundred thousand dollars in lost wages and expenses. She has had her reputation slandered, has been denied training, work opportunity, and advancement opportunity.

All Federal employees who participated in this disparate treatment towards my Mom must be exposed and held accountable. The U.S. Department of Homeland Security, equally with the Equal Employment Opportunity Commission, must be exposed for condoning this illegal behavior.

My Mom and I have endured emotional, psychological, and physical stress since March 2010. Well beyond the stress, anxiety, slander, and lost career opportunities, we continue to have financial hardship because of the expenses they inflicted upon my Mom. My Mom must have a lawyer represent her to seek justice because the EEO Commission does NOT hold accountability; instead the EEOC Administrative Judge blatantly ruled discrimination my Mom received from her managers as normal trials and tribulations of the workplace.

Thirteen main points are listed. ALL ARE IMPORTANT and are listed in sequential order and not necessarily in order of severity.
Following the main points are some CBP Internal Affairs sworn statements and Equal Employment Opportunity Commission hearing testimony excerpts.

1. Discrimination: My Mom was singled out by SCBPO Timothy Borden. In the first professional interaction Borden had with my Mom, he stated to her "Shut your mouth whore, when men are speaking!" followed up with other denigrating comments witnessed by co-workers and in some instances the general public.

2. Harassment: As my Mom attempted to do her job, Borden continued belittling my Mom, speaking condescendingly towards her, making false accusations against her, ordering her not to perform her official duties, then he made claims she didn't perform her duties.

3. Retaliation: As my Mom stood up to Borden, he and Port Director Donna Dedeaux treated her differently than all the other employees; singling her out, speaking condescendingly to her, ordering her to not perform her official duties, and then questioning her work ethics, denying her overtime, falsely reporting to superiors in Cleveland, and submitting altered documents to use against my Mom in the court of law.

4. Hostile Work Environment: Borden and Dedeaux created an extremely hostile work environment singling out my Mom and creating chaos, stress, and anxiety within the duty station. Because of all the scrutiny on her and her duty station, her co-workers became angry from the scrutiny in the office, distancing themselves from, and ultimately becoming very resentful towards my Mom.

Co-workers placed an image of Borden on the blinds in her work areas and even cut the eyes out placing them in cabinets, at her computer, and in her desk - because they knew the severity of Borden monitoring my Mom. It became a joke to them, but that became additional harassment towards my Mom. How could anyone not see this as a managerial created hostile work environment? Co-workers text her pictures on her days off work.

Port Director Dedeaux made my Mom move her work station from the USDA office where she was stationed to sitting at a desk outside Dedeaux's office door and directly in front of SCBPO Borden. "14 feet as a crow flies," is how Borden described it to Internal Affairs the proximity of my Mom's work station to his desk. He sat facing my Mom's profile; she was under his constant scrutiny. Another employee switched desks thinking "it wouldn't last" and then that employee held resentment against my Mom because he received the wrath for being in the same job title.

Notes documented to herself on October 21, 2010:
"Yesterday Officer RC told me 'She [Donna Dedeaux] hates you [Mary] so much that when she walks out of her office and looks at you I can see it, then she turns and takes it out on me [RC].' He said he, feels discriminated against because of his job title (they have no respect for agriculture) and said he is the "whipping boy" and he hates sitting there because every time they look at us they try to find busy work for us. Also, he has to get all the faxes, do all the busy work but she never assigns it to Officer EC or MW because they are CBPOs. He shared with me he told officer EC who nodded in agreement. When I'm [Mary] on "hold" on the phone or sitting at my desk she makes comments like "you need some work to do?" yet never makes any comments to the officers yet they surf the net or read books. RC reminds me all the time how they are gunning for me."

5. Disparate Treatment: Managers kept a continuous monitoring of my Mom - even documenting they were monitoring her. While CBP managers were busy harassing my Mom, managers overlooked other employees who were failing to perform their official duties.

6. Exposing Millions of Wasted Tax Dollars: In the 2012 fiscal year alone, U.S. taxpayers paid $62 million dollars in EEO discrimination case settlements. The EEO Commission Administrative Judges put blind eyes to cases like my Mom's.

7. Exposing Violation of CBP Policy: Such as: managers using government vehicles for personal use, assigning officers to perform personal errands on official time, receiving pay while not at work, routinely arriving to work late and leaving early, leaving private employee information like their names and Social Security numbers unsecured.

PD Dedeaux routinely left a Government laptop computer unsecured with usernames and passwords written on a note attached to the laptop keyboard.

8. Exposing Abuse of Authority: Borden, Dedeaux, and other CBP supervisors or acting supervisors did not have required approval to deny aircraft from arriving at the port of Toledo in several instances, but did so anyway. Managers "cherry-picked" assignments -which is not least cost to government as required by policy - These overtime assignments should be assigned to lower waged officers.

9. Exposing the "Good "˜Ol Boy Network": Where Cleveland used Port of Toledo as a "breeding ground" to bring their buddies from Cincinnati, OH to fill a vacant managerial role to "gain experience" for a short amount of time. These employees would then be transferred to Cleveland to fill advanced managerial positions such as "Chief" "Port Director" "Assistant Area Port Director."

10. Exposing Costs to the Public: Borden illegally detained a vessel from departing the United States for approximately 4 hours so my Mom would not get overtime. How would you like to arrive into the United States and be illegally detained, by no fault of your own, so an abusive Customs supervisor could carry out his personal agenda?

11. Exposing PD Donna Dedeaux: Dedeaux presented altered documents twice to mar my Mom's reputation.

In the first instance, CBP Attorney Amy Baines presented unsigned unofficial documents to be used as official during EEOC Discovery process, but then provided altered versions of the documents to be used as evidence in the EEOC Hearing.

In the second instance, PD Donna Dedeaux then presented these altered documents to Internal Affairs for a second interview in June 2011 in her attempts to mar my Mom's work performance.

12. Exposing perjury: to Internal Affairs and EEOC

In numerous instances SCBPO Timothy Borden and PD Donna Dedeaux committed perjury.

13. Exposing lack of accountability:
"¢ CBP Managers failing to follow policy.
"¢ CBP Internal Affairs failing to hold accountability.
"¢ CBP attorneys are not minimizing damages but spending millions of taxpayers' dollars defending discrimination, harassment, retaliation, disparate treatment, lies, deception, and perjury.
"¢ NTEU Union failing to intervene or assure CBP followed EEO policy.
"¢ The Equal Employment Opportunity Commission failing to rule on law. Even when the facts were clear, concise, and presented directly to him, the EEOC Judge put a blind eye to justice.

Millions of dollars of tax money are spent annually by the U.S. Department of Homeland Security to cover up the wrong doing of managers. Most harassed employees put up with it or quit. For some, like my Mom, the latter is not an option. Nobody should endure the stress we have endured.

The second time I became uncomfortable with the question because I knew the meaning of the slang term and felt it inappropriate for Borden to be asking her about this topic, especially after the third time." Note: Borden tells Internal Affairs under sworn oath that he doesn't remember saying derogatory terms directly to CBPAS Brainard but multiple witnesses report under sworn oath that he did. Also, Borden admits to using these terms in Detroit - but not against my Mom.
100 Q: Internal Affairs stated "...you asked CBPAS Brainard if she knew the meaning of the term "pink sock or pink socks" at least three times. This statement was made in the presence of witnesses. Did you make this statement?..."

Borden states he "understands" how offensive his statements are, and yet he chose to use this denigrating terminology towards my Mom in his role as a supervisory officer representing the U. S. Department of Homeland Security. Borden then conveniently was not be able to recall any of it. Worse, CBP and the EEOC were okay with this and all the other inappropriate harassment Borden directed at my Mom.
In his testimony, Borden rambles that he cannot recall speaking to my Mom this way but he vividly recalls that it has been "20 months since then," and that he answered questions to Internal Affairs in "January 2011" about conversations "eight months prior" but from his "understanding human memory just doesn't work that way" in remembering any of these details my Mom's co-workers all witnessed. Just as Borden couldn't recall the following:

My Mom brought the perjury to the attention of the Administrative Judge. When questioned during this hearing Borden claims that a sworn statement that he both provided and reviewed in writing and signed his name to "was not transcribed correctly. What is even more disturbing is that the Administrative Judge accepted that as an answer. When anyone signs their name to something they must be responsible for reading it and assuring accuracy, instead, both Borden and Treeter qualified his sworn statement. So what was reported in a sworn statement to Internal Affairs under oath was dismissed by the EEOC Administrative Judge.

The Port Director just asked me, because we had so many problems finding you when we had a work assignment, to just note where you were and when you weren't there." SCBPO Borden

HTQ 698 12: So in your monitoring of my activities, you said the Port Director directed you to do that, is that correct?
HTA 698 15: "To note your breaks or when you weren't in the office when we needed you for a work assignment." SCBPO Borden.
Note: My Mom never missed performing her duties. She missed one voluntary overtime assignment, and that was the week she was obtaining a Civil Protection Order against SCBPO Timothy Borden.
HTQ 698 18: Other than the Port Director instructing you to monitor my breaks, has she ever instructed you to monitor any other employees?

More than one officer made sworn statements that Borden would not allow an officer to retrieve my Mom for a muster and stated "Borden said, no, I'll deal with her later" prior to the muster (meeting):
72 A: "Mary was not present (for a muster) and CBPO DMH offered to go and get her. SCBPO Borden stopped him and said, ["No, I'll deal with her later."] If it had been anyone else, someone would have just gone and gotten them." MW
Borden stated:
HTA: 701 20: ": we had already started the muster and Officer DMH offered to get you and we had already started the muster (sic) and I said, "we're going to finish the muster and then I'll present the information to" you later - - well, "to Specialist Brainard later." SCBPO Borden
And Port Director Dedeaux Internal Affairs sworn statement:
79 A "He (Borden) told me that he did not have anyone go get her, because he would give her the muster later that day....." PD Dedeaux

On 7/7/10 Borden formally made a written false claim to Dedeaux of physical assault against him by my Mom he alleged occurred on 3/31/10 - 97 days prior to his allegation. - One day later on 7/8/10 PD Dedeaux issued my Mom a "cease and desist" letter before speaking with Borden's alleged "witness" who was on vacation and did not return to work until the following week. Dedeaux testified that she had spoken with the witness prior to issuing the cease and desist memo.

Borden had admitted under oath to using harassing verbiage routinely in Detroit, contrary to CBP Code of Conduct while "not recalling" his verbal assaults at my Mom. CBP management continued to allow Borden to be in a supervisory capacity while forcing my Mom to continue to report to him, and ultimately she had to work alone with him.

Internal Affairs Report of Investigation narrative stated:
"While unable to recall or remember instances wherein his conduct could be called into question, SCBPO Borden was able to vividly recall events involving CBPAS Brainard's deficiencies or shortcomings citing dates, times and locations." C-611

78 Q: Internal Affairs asked SCBPO Timothy Borden "Have there been any other similar complaints by any other CBP employees while you have been employed by CBP, including your time at Detroit Metropolitan Airport in Romulus, MI? If so, what occurred?"

102 A: "I found out that they were trying to file an assault charge against her (Mary). It sounded to me as if they were trying to coerce her into not continuing with the EEO complaint." DMH

HTQ 471 6: Could you recall the pet chew interception and your thoughts on what Borden was doing in reference to my inspection?
HTA 471 9: "From what I recall, he was very confrontational towards you during that time." DMH

Note: The above article listed the interception where CBPAS Brainard did most all the work but Borden listed himself, PD Dedeaux, and the other CBPAS. This prohibited product interception was only the result of CBPAS Brainard continuing to perform her duties even after Borden ordered her to release it. Borden and Dedeaux were recognized several times for the work done by CBPAS Brainard. To the present, CBPAS Brainard has never been recognized for this interception.

The first Internal Affairs investigation was from November 2010 when my Mom contacted IA and asked for their intervention to get the harassment to stop.
A second IA investigation occurred in June 2011 when PD Dedeaux reported to Internal Affairs a co-worker reported an alleged concern about my Mom:
Internal Affairs stated at the end of Dedeaux's second interview:
"When asked if she had anything further to add to her written affidavit, PD Dedeaux produced numerous email correspondence documents, some dating back to when AS Brainard was in training, outlining AS Brainard's work performance and interactions with others. The Internal Affairs Investigator asked PD Dedeaux why she would have taken the time to research all of this, given that her sole purpose was to report an incident brought to her attention by Officer EC."
PD Dedeaux added to her sworn statements at the end of her interview:
A: 120 "I got the feeling during my interview for this incident that it is being perceived by the investigator(s) that I made this report as a point of retaliating toward Brainard. I would like to note that had Officer EC not bought (sic) this incident to my attention, I would not have made the report to the JIC (Joint Intake Center)...." PD Donna Dedeaux

HTA 837 12: (Officer EC) came to me and he said that he had been wrestling with an issue for a while. PD Dedeaux
HTQ 840 9: Was he hesitating on bringing this to your attention?
Agency Attorney Amy Baines objected but the Administrative Judge overruled.
HTA 840 21: "I would say he was probably hesitating." PD Dedeaux
HTQ 841 2: Did you provide any documents to Internal Affairs in reference to me?
HTA 841 4: "I provided his statement, I'm pretty sure that's what I provided. They told me to bring your personnel file and they reviewed that as well." PD Dedeaux

HTQ 841 10: - - to take my personnel file?
HTA 841 11: "Yes." PD Dedeaux
HTQ 841 12: So they specifically requested for you to bring a file?

HTQ 841 15: "When did you produce - - when did you provide documents to Internal Affairs during this interview?
HTA 841 18: "During the interview." PD Dedeaux
HTQ 841 19: So was this upon your arrival you gave them my employee file or how did you - - or this personnel file?
HTA 841 22: "No, it wasn't immediately upon arrival. It was at some point throughout the interview they asked to review it." PD Dedeaux
HTQ 842 3: They asked you to review them?
HTA 842 4: "Yes." PD Dedeaux
HTQ 842 5: Did you urge Officer EC to provide this document that you produced to them?
HTA 842 8: "Which document?" PD Dedeaux
HTQ 842 9: Did you urge Officer EC to write - - to submit a memo to you in reference to what he discussed with you?
HTA 842 12: "Urged, no. I told him if he felt it was - - if he truly felt it was that serious of a matter then he needed to present me with a memo so I could handle the situation." PD Dedeaux
HTQ 842 16: And when did Mr. EC bring this information to you? Did he meet you in your office or how did - - how did he approach you when he brought this information to you?
HTA 842 20: "Yeah, he came in my office one day. I couldn't tell you the exact date and time though." PD Dedeaux
HTQ 843 1: And was it specifically his concern?
HTA 843 2: "Yes." PD Dedeaux
Presented documented evidence, my Mom asked to Dedeaux:
HTQ 844 7: Is that your signature on this form?
HTA 844 9: "Yes." PD Dedeaux
HTQ 844 13: So this would be accurate to the interview that you had with Internal Affairs?
HTA 844 15: "Yes." PD Dedeaux
HTQ 845 1: "Yes. On May 24th, 2011 close to the end of the shift I was having a casual conversation with Officer EC. At that time he told me that he had been wrestling with whether or not he should be - - he should bring an incident to my attention regarding Agriculture Specialist Mary Brainard."
HTQ 845 11: Did I read that correctly?
HTA 845 13: "Yes." PD Dedeaux
HTQ 846 5: .... why did you take documents corresponding all the way back to my training to the Internal Affairs interview?
HTA 846 8: "Because I felt that it was relevant..." PD Dedeaux
HTQ 847 5: Did the (Internal Affairs) interviewers ask you why you took all the time to do the research on this?
HTA 847 8: "Absolutely not." PD Dedeaux

HTQ 868 17: You had informed me that all my emails would be sent to a higher authority.
HTA 868 19: "Uh-huh." PD Dedeaux
HTQ 868 20: Who is that higher authority?
HTA 868 21: "Any of my supervisors." PD Dedeaux
No other employee was having their emails sent to higher authorities yet the Administrative Judge did not recognize this disparate treatment.
PD Dedeaux removed my Mom from assignments and gave her menial tasks. PD Dedeaux removed my Mom from being the specialist for consulting on how to process a large volume of rail car cargo agriculture inspection. Dedeaux then asked her superiors if she could have "an officer" perform the agriculture duties. Then when questioned in court:

HTQ 891 8: Who did you visit that job site with?
HTA 891 9: "You. (CBPAS Brainard)" PD Dedeaux
[Dedeaux had taken Borden with her and not CBPAS Brainard]
But my Mom was removed from consulting how the agriculture inspection would process and was not sent to the job site until a few days later. PD Dedeaux even cost the private sector inconvenience and unwarranted costs. The following letter shows where Dedeaux visited the job site without an agriculture specialist but testified that she went with my Mom. The other agriculture specialist's testimony follows along with testimony about Dedeaux yelling at my Mom, again, denied under oath.


Letter from Project Manager concerning aforementioned events

Internal Affairs sworn statement:
123 A: I asked to have Mary go with me because she was familiar with the inspection. PD Dedeaux would not allow Mary to go with me." RC
HTQ 894 1: Did CBPAS RC request to have me go with him to the job site to finish out those containers?
HTA 894 4: "No."... PD Dedeaux
Internal Affairs sworn statement from a co-worker:
51: "She (Mary) had conducted a container inspection in [Redacted]. I heard Borden and Dedeaux yelling at Brainard for working 15 minutes overtime." EC
The overtime in question was the same overtime referenced in the letter above by the project manager.
Questioning Dedeaux:
HTQ 895 13:... I went down to perform my task inspecting these railcars, I was late returning to the port. Did you yell at me that day for returning to the port and working (15 min) overtime?
HTA 895 18: "...I did not yell at you..." PD Dedeaux
