If you own property, our story is relevant to you. Contrary to what the media has decided to report, this is not a case about mineral rights - this is a battle for our property rights and our Constitutional rights, both of which we are being denied right now.
The Sugar Pine Mine, in the beautiful wilds of southern Oregon is a sustainable, small-scale 'Mom & Pop' type gold mine run by us old guys. The BLM (Bureau of Land Management) is attempting to take our surface rights from us (which we have under the Surface Resources Act of 1955.) This is not typical of mining claims, and in fact, due to the BLM taking other people's surface rights, a claim that has them intact is a rarity indeed these days.
The Sugar Pine was first mined in 1858 and because it is a calim that was staked before the Surface Resources Act of 1955, we control the surface. BLM is trying to take that surface management from us.
We have been ordered by the BLM to destroy our own property and vacate our land, without the due process of law we are given by the Constitution of the United States. There was no court order allowing them to seize our property and we were not allowed a court hearing in order for them to take our property and our land. They have no surface management authority over this mine and are attempting to steal it from under us without a shred of evidence to support their control.
We are currently engaged in what we know will be a lengthy legal battle with BLM who use the legal system (when somebody actually fights back against them,) to keep you in litigation until your resources are depleted and you can no longer fight them.
The BLM is an out-of-control agency currently breaking Federal law and defying the Constitution. And they are lying to the people of this country.
We have asked them, many times to just meet with us and look at the proof of our surface rights but they refuse. They are not interested in our righteous legal position - they do not follow the law, nor even their own regulations.
But we are determined to fight them! To do that takes funds, unfortunately, and since we cannot mine on our own ground right now, we are turning to you, the people of this great country for assistance.
This case is not just about our own local issue - this case is for everybody who owns property, everybody whom the BLM has ever burned out, stolen private land from and tied up in litigation until they were bled dry. We hope that this case will be the end of the abuses against the people that have been perpetrated by the BLM for decades.
