IN DEFENSE OF A DAUGHTER

What would you do if a family member was being assaulted right in front of you? Have you ever said that things are the way they are because nobody seems to care any more? Or they just say that there is nothing you can do about it anyways? I thought the system was put in place to protect us. Have you ever felt a kind of 'dis-connect' from something that had happened to you? I've had that kind of feeling, that something is not right with the system and this is the reason why I say that.
My name is Jessica Hum and the reason I ask those questions is the result of what happened to me and my dad on Dec.8/2015.
The actions that my dad took to protect me from being assaulted has resulted in my dad being charged instead of the man who assaulted me, in the first place. The assault that I am talking about happened in a courtroom in Leduc, Alberta on Dec.8/2015.
To give you a better understanding of what happened, I had elected to challenge a speeding ticket I had recieved which I thought was unfair. The ticket was issued at a construction site on a quiet back road and it was late in the evening when there was absolutely nothing going on there. It had been 'under construction' for a long time and I had heard that this spot was referred to as a 'fishing hole' by the cops and a few other people who have been caught speeding there. I told my dad that it wasn't fair and the only thing he had to say to me was 'do your homework' because I had planned to challenge the ticket.
I found out a lot of things that had a lot to do with 'jurisdictions'. I also found out a lot of things that had to do with the 'Canadian Charter of Rights', your rights under 'common-law', a jurisdiction that nobody seems to be paying attention to, or is even aware of. Most people I talk to think 'common-law' only means two people living together who are not married. I told my dad that I was going to question what jurisdiction I am protected under when I go to court and I asked if he would be there when I do this. I knew he would be there for me because he has always supported me if he thought I was doing the right thing.
The news on Dec.9/2015 stated that 'Alberta Sheriff Attacked in Leduc courtroom' . This article was the official press release of the RCMP and it also stated that a woman 'became disruptive' and an Alberta judge ordered an Alberta sheriff to remove her from the courthouse. The article also said that the sheriff was 'allegedly' assaulted by a relative of hers. The woman the article is referring to is me.
When I was called up in court before my so called 'trial' was to begin, I asked the judge if my common-law rights would be recognized in court. The judge didn't even answer the question and I asked again. The judge started to get very loud and started to yell at me, and then accused me of being 'one of those freeman types' which I knew very little about . It was the judge who was the most disruptive with his yelling, all he had to do was answer my question and everything would have been fine. Instead he tried me in absentia and then ordered the sheriff to remove me.
The sheriff came at me and grabbed me pretty hard by the arm. When my dad seen what was happening, he got up and said very clearly to the sheriff, 'don't you lay a hand on my daughter'. After the sheriff grabbed me my dad said to the sheriff 'take your hands off my daughter' and then tried to step in between me and the sheriff with his back mostly towards the sheriff, facing me. The sheriff never said a word to me, he just came straight at me and grabbed me, my dad reacted instinctively to protect me from him.
My dad never 'attacked' anybody, my dad was facing me with his back towards the sheriff trying to separate him from me. That was when without any warning at all this sheriff let go of me and grabbed my dad, this sheriff threw my dad with enough force for my dad to clear the bar and land on top of the crowns desk and then land on the floor where the court clerk sits. This sheriff wasn't done and charged after my dad again, in doing so, he got all tripped up in the mess where the crowns desk was and face planted himself into the floor beside where my dad had landed.
There were about 6 or 7 other RCMP and sheriffs in the courtroom during this time and they all got up and surrounded my dad, a couple of them grabbed my dad and slammed him back down to the floor where my dad's head hit the floor pretty hard. All of these cops and not one could say anything to my dad. They all swarmed him, slammed him to the floor and while he was being held down by three officers, the same sheriff that threw my dad in the first place must of felt that this was not enough and then proceeded to start kneeing my dad in the back multiple times while he was being held down by all these officers.
This is what had happened that led to my dad being charged with assault on a peace officer, disturbing the peace and obstruction. While my dad was being 'processed' which took more than a few hours, during this time he was in extreme pain, and after they released him I took my dad to the hospital where they had to take x-rays of his back and rib area. My dad wound up with a cracked rib and deep internal bruising to the organs in the small of his back from the un-necessary beating inflicted by these cops.
It took almost a month for my dad to start walking normally again (he is in his mid 50's). He hasn't been back to work since that incident happened, hopefully he will be soon. I love my dad very much but it bothers me alot when my dad keeps telling me everything will be fine when I know it's not. I know the bills are starting to pile up and his legal fee's are just starting to add up as well.
I started this 'Go Fund Me' campaign to help my dad fight these false charges. My dad has never been charged with anything before, has no criminal record and has always been a law-abiding person and said that he would do what he did again if he had to, and that he would do the same thing for anybody who was being assaulted or in need of help, because that is just who my dad is and what he is all about. He says that it is all about the principle of the matter, the main reason why he needs to fight these charges. Just because that man wears a uniform doesn't mean that he is or should be exempt from the law, and it doesn't matter where it happens, inside a courtroom or out on the street. That uniform and badge doesn't mean that he can act and behave like a goon and get away with it.
My dad calls himself 'old school' and he talks about the time when he used to be in the military when the 'Canadian Charter of Rights' was first introduced. I didn't really pay a whole lot of attention to what he said and what he meant about public perception and the law the way it is enforced today. This is what my dad had to say.
'How the public perceives the uniform and the institutions they represent is a direct reflection of how serious the person wearing the uniform believes in the oath they swore for the privelege of wearing it.'
It would be sincerely appreciated by me for all the help I can give my dad. I have come to realize that what my dad is standing up to can happen to anybody because I never thought it would happen to us. My dad thinks that the legal system has some serious problems in it and that if he just 'rolls over' to make it all go away, then he would be no better than the next person who either doesn't know or just doesn't care and by doing that he accepts that so called 'sworn oaths' are nothing more than a useless ritual to get a gun and a badge.
My dad hopes that this case will set a precedent for other people who may find themselves in a similiar situation, who knows, it could happen to you or somebody you know, but he needs to beat these charges first. At least the news article released Dec.9/2015 got one thing right, my dad's name. His name is Gene Hum, he is my father and I am so proud of him for protecting me that day and for taking a stand against what is wrong in todays world even if it may cost him his livelyhood.
Hopefully the target amount that I have set is going to be enough and if it is more than enough, then I will help out with the SPCA and The Big Brothers and Sisters charities because I think that sometimes they need all the help thay can get.
