Hi, My Name is Krista, and I am the Aunt of Trinity Fry. Trinity is three years old and has lived with me for two years as her mother dropped her off at my house and didn't come back. Trinity's father helped pay for things as he could but was an over-the-road truck driver and could not commit to taking care of Trinity full time. Finally, Jan 2021, he got a place and married his fiance of 2 years. Trinity made a successful transition from my home to living with her father at that time. She enrolled in gymnastics and preschool, made friends in the local apartment complex they are living, and secured a doctor locally for annual checkups.
However, after Trinity's 3rd Birthday, her biological mother reappeared and wanted visitation with her daughter. Trinity's father allowed this to happen as he did not want to keep his child from her mother.
In Oct 2021, she took the child and refused to give her back. In Nov 2021, I was able to go to the place the mother was staying to see what was going on and try to talk. The Mother, Great Grandmother, and Grandma became physical and attempted to seriously harm Trinity, myself, and Trinity's father. We were able to make it out of the general area and speak with the police about the incident and leave with Trinity. After this incident, the mother filed for full custody.
We attempted to get a lawyer, but we could not secure one before the trial date was set due to finances. However, we did speak to several lawyers, and they stated that because the mother abandoned her child for three years, this shouldn't be much of a fight, along with the proof of her being homeless and unemployed.
The trial came (Hickory county Mo), and the mother confirmed under oath that she had given her child away but wanted her now; she confirmed she was living with her mother currently and was unemployed but planned to seek employment. The Trinity's lawyer even verified under oath, with my guardianship documents signed and notarized by both parents, that she lived with me for over two years. That the mother was staying with her mother, for the time being, being unemployed.
I brought up that the mother didn't stay with her mother full time but lived part-time with her new husband's family. (yes, she married her new boyfriend during this court case)....but when she denied it, there was no lawyer to refute the fact.
After all of this testimony, somehow, the Judge awarded Sole physical custody to the mother because the father was employed. YES, you read that correctly; the judgment stated due to the gathers employment, the court would understand the step-mother would be taking care of said child. So the father is being punished because he is employed, his work schedule is Mon-Thur, and the child's stepmother (the only real mother she has known) would be taking care of her.
We have until June 23rd to hire a lawyer and appeal the decision, and while we have some finances saved up for the consultation fees, we need help as this will be a fight no father should have to endure. Nor a punishment no child should be subjected to.
