Help the 4 widows of te Ogoni 9 -The case in brief

27 years ago, nine innocent Nigerians – who were fighting against oil pollution in Ogoniland by Shell – were unjustly killed by hanging.

They were convicted of murder after a kangaroo trial based on false testimonies, for a murder they had nothing to do with. Witnesses quickly came forward, stating that they had been bribed by employees of the Nigerian government and Shell. However, the world watched as the Ogoni 9 were hanged before they could even appeal their convictions.

Four widows have been fighting for justice ever since and have taken Shell to court. However, the court deemed the evidence insufficiently compelling and Shell has refused to pay compensation for damages.

Who are the Ogoni 9?

Ken Saro-Wiwa, Saturday Dobee, Nordu Eawo, Daniel Gbooko, Paul Levula, Felix Nuate, Baribor Bera, Barinem Kiobel and John Kpuine were killed by hanging on 10 November 1995 after a kangaroo trial. They were all Ogoni who fought for a better future for their country.

Ogoniland in Rivers State, Nigeria, is the center of the country's oil production. Shell earns an important part of its revenue from Ogoniland, but the area became increasingly polluted due to the many oil leaks and the Ogoni people became increasingly poor. It is for that reason MOSOP was founded in the 1990’s: the Movement of the Survival of the Ogoni People. MOSOP demanded that the people of Ogoniland should also benefit from the oil extraction on their land and that the oil pollution caused by Shell should come to an end.

Shell enlists the army

The uprising in Ogoniland was highly inconvenient for Shell. The cessation of its activities in the area causes it to lose important revenue. On several occasions therefore, Shell calls upon the army’s special forces. And multiple times, the violence completely escalates. Nevertheless, Shell continues to put pressure on the authorities to put an end to the resistance in Ogoniland.

The Arrest of the Ogoni 9

In 1994, the army conducts a major sweeping operation in Ogoniland. Hundreds of people are arrested, tortured and shot. Shortly afterwards, and as part of this clampdown, the Ogoni 9 are arrested. They are suspected of murder and incitement to murder of 4 Ogoni Chiefs. Many of the men were not even around at the time of the murders. Witnesses later state that they were bribed by the army and Shell to deliver false testimonies. Even so, the false statements are used and the men are found guilty and hanged.

4 widows start a lawsuit against Shell

Esther Kiobel started her lawsuit against Shell in the United States in 2002. The charge: complicity to the executions of the Ogoni 9. After ten years of litigation, the US Supreme Court ruled that the US courts had no jurisdiction to hear the case. Not long after, she continued her fight for justice in the Netherlands, together with Charity Levula, Blessing Kem Nordu and Victoria Bera.

In 2009, Shell settled with other widows for a staggering $15.5 million. Esther, Victoria, Blessing and Charity were left empty-handed. Their lives are still completely dominated by the terrible events of 1995.

In 2019, the District Court of The Hague decided that Shell had to answer for the events in 1995. But in 2022, the court also held that the widows had not proven that Shell had bribed witnesses. This, in spite of the witnesses who had come to testify about this in The Hague and despite all the evidence of Shell's complicity brought forward by the widows.

After more than 20 years of litigation in different countries, the women have now decided to end their fight.

Help the widows to move on with their lives

The widows fought for years to clear their husbands' names and to have Shell take responsibility for its role. However, the legal system has been unable to help them, and Shell has left them out in the cold. Esther and Victoria were forced to flee from Nigeria after 1995 and attempt to build new lives for themselves abroad from scratch. Blessing and Charity were left in Nigeria without any form of income or support. Blessing is sick but cannot afford her medical expenses.

Who created this Go Fund Me page?

This page has been created by Hilde Brontsema, with help from Channa Samkalden. Hilde has spent the past 6 years working on lawsuits against Shell, including the lawsuit against Shell in Nigeria. She traveled to Nigeria to make several documentaries about the oil pollution in the country. Channa Samkalden is a lawyer and represented the widows in this case. Channa is specialized in accountability for human rights violations. In 2021 she won the case filed against Shell by 4 Nigerian farmers and the Dutch branch of Friends of the Earth (Milieudefensie).

The money that we raise will be transferred in equal parts to the 4 women.

27 jaar geleden werden 9 onschuldige Nigerianen opgehangen die streden tegen de olievervuiling door Shell in Ogoniland. Op basis van valse getuigenissen werden de mannen na een schijnproces veroordeeld voor een moord waarmee ze niks te maken hadden. Getuigen verklaarden al snel dat ze waren omgekocht door medewerkers van de Nigeriaanse overheid en Shell. Maar de wereld keek toe toen de mannen, nog voordat ze beroep konden instellen tegen hun veroordeling, werden opgehangen.

4 weduwes strijden sinds de dood van hun mannen voor gerechtigheid en sleepten Shell voor de rechter. Maar de rechter vindt het bewijs niet overtuigend genoeg en Shell weigert een schadevergoeding te betalen.

Wie zijn de Ogoni 9?

Ogoniland in Rivers State, Nigeria, vormt het centrum van de oliewinning in het land. Shell haalt er een belangrijk deel van zijn opbrengsten vandaan, maar het gebied werd door de vele oolielekkages steeds vuiler en de Ogoni steeds armer. Om die reden erd in de jaren 90 MOSOP opgericht: de Movement of the Survival of the Ogoni People. MOSOP eiste dat de bewoners van Ogoniland zouden meeprofiteren van de oliewinning op hun land en dat er een einde zou komen aan de olievervuiling door Shell.

Shell huurt het leger in

De opstand in Ogoniland komt Shell niet gelegen. Doordat het zijn activiteiten moet staken loopt het belangrijke inkomsten mis. Meerdere malen doet Shell een beroep op de speciale troepen van het leger. En meerdere malen escaleert het geweld volledig. Toch blijft Shell druk uitoefenen op de autoriteiten om korte metten te maken met het verzet in Ogoniland.

In 1994 vindt er een grote schoonveegactie plaats door het leger in Ogoniland. Honderden mensen gearresteerd, gemarteld en neergeschoten. Als onderdeel van deze actie worden niet veel later ook de Ogoni 9 opgepakt. Ze worden verdacht van moord en aanzetting tot moord op 4 Ogoni Chiefs. Veel van de mannen waren niet eens in de buurt ten tijde van de moorden. Getuigen verklaren later dat zij door door het leger en Shell zijn omgekocht om valse getuigenissen af te leggen. Toch worden de valse verklaringen gebruikt en worden de mannen schuldig bevonden en opgehangen.

4 weduwes starten een rechtszaak tegen Shell

Esther Kiobel begon in 2002 in de Verenigde Staten haar rechtszaak tegen Shell. De aanklacht: medeplichtigheid aan de executies van de Ogoni 9. Na tien jaar procederen oordeelde het Amerikaanse Hooggerechtshof dat de rechter in Amerika niet bevoegd was om over de zaak te oordelen. Niet lang daarna zette zij in Nederland haar strijd voor gerechtigheid voort, samen met Charity Levula, Blessing Kem Nordu en Victoria Bera.

In 2009 trof Shell met andere weduwes een schikking voor maar liefst $15,5 miljoen. Esther, Victoria, Blessing en Charity bleven met lege handen achter. Hun leven staat nog altijd volledig in het teken van de verschrikkelijke gebeurtenissen van 1995.

De rechtbank besloot in 2019 dat Shell zich moest verantwoorden voor de gebeurtenissen in 1995. Maar de rechtbank concludeerde in 2022 ook dat de weduwes niet hadden bewezen dat Shell getuigen had omgekocht. Ondanks de getuigen die daarover in Den Haag waren komen verklaren en ondanks al het bewijs van Shells medeplichtigheid dat de weduwes hadden aangevoerd.

Na ruim 20 jaar procederen in verschillende landen hebben de vrouwen nu besloten hun strijd te staken.

Help de weduwes verder te gaan met hun leven

De weduwes hebben jaren gestreden om de naam van hun echtgenoten te zuiveren en Shell verantwoordelijkheid te laten nemen voor zijn rol. Maar het rechtssysteem heeft ze niet kunnen helpen en Shell heeft ze in de kou laten staan. Esther en Victoria moesten na 1995 vluchtten en uit het niets proberen een nieuw leven op te bouwen in het buitenland. Blessing en Charity bleven achter in Nigeria, zonder enige vorm van inkomen of steun. Blessing is ziek maar kan haar medische kosten niet betalen.

Wie hebben deze Go Fund Me pagina opgesteld?

Deze pagina is opgesteld door Hilde Brontsema, met hulp van Channa Samkalden. Hilde werkte de afgelopen 6 jaar aan rechtszaken tegen Shell, waaronder de rechtszaak tegen Shell in Nigeria. Ze reisde naar Nigeria om daar verschillende documentaires te maken over de olievervuiling in het land. Channa Samkalden is advocate en vertegenwoordigde de weduwes in deze zaak. Channa is

gespecialiseerd in aansprakelijkheid voor mensenrechtenschendingen. In 2021 won ze de zaak van 4 Nigeriaanse boeren en Milieudefensie tegen Shell.

Het geld dat we met deze inzamelingsactie ophalen zal in gelijke delen aan de 4 vrouwen worden overgemaakt.
