Restaurants & Wineries Coalition for Safe Reopening
Our businesses have been at the forefront of keeping our employees and patrons safe. We have collectively spent hundreds of thousands of dollars in the last ten months adapting to the roller coaster of Covid-related mandates and day-to-day changes from the state for our businesses to operate safely. In addition, but not related, many of us have seen economic devastation resulting from the wildfires.
With this greater surge on the way as a result of holiday travel and family gatherings, our current restrictions are going to extend well past January 8th. There is no supporting data or science being presented for the arbitrary discrimination and demonizing of our businesses for the state's restrictions. Our outdoor activities are not the cause for the spread of COVID-19 or the current surge in the Bay Area. In fact, more data is coming out in studies around the country that outdoor activities, including outdoor dining, are one of the lowest ways to contract COVID-19. No more than about 1.4% of cases may be the result of restaurant-related activity. Home and family gatherings are making up close to 80% of the surge.
Our employees and our businesses cannot continue to get punished for the actions of others. It is time to take matters into our own hands and move forward with legal action so we can safely reopen our businesses for outdoor activities.
Legal Challenge.
The Governor’s ban on outdoor activities including outdoor dining and tastings violates state and federal constitutional principles. While states may have broad discretion to promulgate health and safety laws, that authority is not unlimited, even in emergencies. The law must at least have a rational basis, and treat similarly situated businesses the same. The substance and structure of the health law fails both of these constitutional requirements.
Final Cost.
We are seeking to raise $78k for the final legal bill as we were successful in getting out outdoor operations open!!
