Airbnb Host: Class Action
Donation protected
The Problem: Airbnb unilaterally, and in violation of the terms of use, refunded guests who booked reservations with hosts who had strict or super-strict cancellation policies without host consent. As a result of these breaches, Airbnb hosts have viable legal claims against Airbnb. Airbnb is seeking to preclude hosts from acting as a group to assert their legal rights. Hosts want accountability from Airbnb.
Airbnb Has Implemented Barriers to Collective Action: Airbnb seeks to force hosts to waive their right to file a Class Action Against Airbnb and force only individual arbitrations. By making it economically difficult for any single host to exercise legal leverage, Airbnb has avoided any real accountability.
Collective Action By Airbnb Hosts Is Critical To Effect Change: There are hundreds of thousands of Airbnb hosts globally asking Airbnb to uphold their end of the bargain. Hosts are making substantial capital investments directly tied to the Airbnb platform. They require predictability, follow through by Airbnb, transparency, and accountability. Airbnbs lack of transparency and lack of accountability. Learn more about the class action attorneys representing hosts.
This Legal Fund (we have closed the Fund): Our attorneys have analyzed the terms of service, the extenuating circumstances policy, the arbitration mandate, the class action waiver, and other contract issues. Enabling hosts to share some of the legal fees and costs to put the best arguments and strategy forward makes sense.
- Did you know certain terms in a website clickwrap agreement such as Airbnb's terms of service can be found enforceable by an arbitrator or judge?
- Did you know that there are good-faith legal arguments which could allow Airbnb hosts to act collectively despite Airbnb's attempted restrictions?
- Do you agree that hosts have a common interest in resolving issues about the legal application of the terms of service and extenuating circumstances policy?

LEGAL STUFF: By donating, you affirm that your motivation is to help fund a cause you believe in, and not for any other purpose. The most important thing you need to understand before donating is that a donation does not create an attorney-client relationship between you and Traverse Legal. Donating will not mean that we are your attorneys. We are only representing hosts who hire us in that capacity. We are not your lawyers until we conduct a conflict check and both agree to representation. If you wish to retain Traverse Legal, PLC as your attorneys, please contact us.
