CAS & ATHLETES STANDING UP FOR THE OLYMPIC VALUES

Svenska OS-kvalificerade atleter nekas OS-plats av Sveriges Olympiska Kommitté i strid med den Olympiska stadgan – stöd kampen i Idrottens skiljedomstol.

Den 3 juli 2024 avslog Sveriges Olympiska Kommitté (SOK) inbjudningar för totalt 9 friidrottare som kvalificerat sig för de Olympiska spelen 2024 enligt Internationella Olympiska Kommitténs (IOK) kvalificeringsregler.

SOK använder dock sina egna urvalskriterier, som säger att inbjudna atleter måste bedömas kunna konkurrera om en topp-12 placering för att vara berättigade till en uttagning. Som ett resultat av detta avslog SOK slutligen inbjudningar till 9 potentiella olympier, med undertecknad Emil Bengtson från Svenska Seglarförbundet som drabbades av samma öde.

Denna praxis är en tydlig överträdelse av de Olympiska stadgarna, som fastställer att de nationella olympiska kommittéerna inte har befogenhet att frångå kvalifikationsprocessen som fastställts av IOK och respektive internationella idrottsförbund. Detta bekräftas av professor Daniel Stattin vid Uppsala universitets juridiska fakultet, som utfärdade ett uttalande till stöd för denna ståndpunkt.

För att atleterna ska kunna få sitt fall rättvist prövat (vilket även omfattar tidigare drabbade atleter) och för att framtidens atleter inte ska drabbas har de 6 undertecknade inlett ett ärende i den internationella Idrottens Skiljedomstol (CAS) mot SOK.

Att driva fallet i CAS är både brådskande och kostsamt. Därför har atleterna startat en akut insamling, som ska täcka de juridiska kostnaderna i fallet. Eventuellt överskott eller om skiljedomen skulle utebli, kommer insamlingen att doneras till den ideella organisationen Aldrig Ensam. Ställs skiljedomen in kommer donationerna att återbetalas minus avgiften som tas av GoFundMe.

Liknande praxis tillämpas i andra länder, t.ex. i Storbritannien och Spanien. Atleternas förhoppning är att skapa ett prejudikat för andra olympiska atleter som nekats sina platser. Detta för att säkerställa att framtida olympier får en chans att representera sitt land och genom idrott inspirera ungdomar till en bättre och mer fredlig värld, i enlighet med den Olympiska stadgarnas vision.

Swedish Olympic qualifiers denied Olympic berth by National Olympic Committee in violation of the Olympic Charter – support the fight in the Court of Arbitration for Sport

On July 3rd 2024 the Swedish Olympic Committee (SOC) rejected the invitations of a total of 9 track & field athletes who had qualified for the 2024 Olympic Games in accordance with the rules decided by the International Olympic Committee (IOC) and World Athletics.

However, the SOC employs its own selection criteria, which state that invited athletes must be deemed able to compete for a top-12 position in the Olympics to be eligible for selection. As a result, the SOC ultimately rejected 9 invites of Olympians-to-be, with signee Emil Bengtson of the Swedish Sailing Federation suffering the same fate.

This practice is a clear violation of the Olympic Charter, which states that the National Olympic Committees do not have any special power to interfere with the qualification process set out by the IOC and the respective International Sport Federation. Strengthening the case is Professor Daniel Stattin of the Uppsala University Faculty of Law, who issued a memorandum in support of this view.

To administer justice for affected athletes in the past, present and future the 6 signees have opened a case in the international Court of Arbitration for Sport (CAS) against SOC.

The athletes urgently need to raise funds to cover the legal costs for the arbitration. Any surplus will be donated to charity “Aldrig Ensam” (Never Alone, mental health), and in the case of a suspended trial the donations will be returned minus the fee taken by GoFundMe.

Similar practices have taken place in other countries, including Great Britain and Spain. Our hope is that a successful case can set a precedent for other Olympic athletes denied their spots and ensure that future Olympians will get a chance to represent their country and through sport inspire the youth to a better and more peaceful world, in accordance with the vision of the Olympic Charter.
