Update: The minutes for April 6 ZBA Meeting were approved with no material changes. We provided a letter of violations of the ZBA stipulations.
There is a Zoning Board meeting Thursday July 6 at 6pm that includes an agenda item to approve the April 6th ZBA meeting minutes (link attached). The proposed minutes do not reflect accurately the actual meeting activities or the many extremely negative comments from community members. Please come to the meeting to request the Minutes are corrected for the record.
There continue to be numerous code violations including truck traffic on South Ave., dumping on the site, screened materials, and more than 8 piles. They still have not appeared before the Planning Board for approval.
June 12, 2023 - We were told this is a green "recycling" company. In fact, per the Village and Code Enforcement this company has leased and has "the right to clear-cut" approximately 41.5 acres at the location of 180 South Avenue. They have not appeared before the planning board with their site plan yet. If you have driven by, you have seen see the dump yard, the screener and the huge numbers of piles of trees, asphalt and concrete. There are numerous unaddressed code violations including having more than 8 piles, and excavating on the land that has been previously contaminated.

On April 6, 2023, the Village of Brockport Zoning Board of Appeals granted an area variance at 180 South Avenue (former truck terminal), currently zoned Limited Industrial Use District. Pending Village Planning Board approval (date TBD) applicants may begin grinding, screening and dyeing materials into mulch, collecting and storing construction waste, and screening topsoil. They are actively operating now and there has been no code enforcement.
Over 70 Village of Brockport and Town of Sweden residents attended the April 6 public hearing, with at least 20 people stating their strong concerns. These concerns include a decrease in residential property value, the lack of an environmental review, the impact on our quality of life in our community such as grinding machinery noise, chemical odors, dust, run-off into the Brockport Creek, increased truck traffic, fire risk and many other health and safety issues.



The Zoning Board of Appeals determined the project would not have a significant adverse impact on the quality of life of the neighboring homes or the environment and proceeded to grant a variance!
We disagree with the area variance approved by the Village of Brockport Zoning Board of Appeals for 180 South Avenue. This land is situated on a historic and well-traveled street, directly adjacent to many Village and Town residents' houses. This variance allows the manufacturing operations to occur outside, which are required by Village Code to take place inside.
We have retained a well-known Rochester attorney to represent us in an action against the Village of Brockport. Please donate to our fund to pay attorney's fees to represent our numerous fact-based concerns. Thank you for helping us to retain the quality of life in this community that we all love!
