Millions of Australian Facebook users could potentially be liable and sued for other people's comments below their posts, if argued to be defamatory and I am challenging this in Victoria's highest court, the Court of Appeal of the Supreme Court of Victoria.
It means you personally can be sued for what another person writes below your post (even if you delete it when notified), the same applying to a page (voluntarily) administered, or to a group (i.e. community noticeboard or hub) where the posts and comments are made by others. I am sure you want to avoid a six-figure legal case like mine! Our team are arguing on many grounds why this must change.
My case relates to a Facebook page created at age 16 called the Carrum and Patterson Lakes Forum advocating for investment in those suburbs. Ten years on, News Corp remarked on my leadership of campaigns for several of the region’s largest projects, including the Mordialloc Freeway amongst backing 70 community causes totalling “more than $540m .” The posts (not an issue themselves) related to a property development including two 10-storey buildings and compliance, which were later investigated by the Victorian Ombudsman. I was sued for comments made below those posts from community members and this could happen to anyone.
Being of national interest, this has been raised in the Victorian Parliament twice and in most Australian capital city newspapers. Donations will continue to support our work for all costs and orders associated with proceedings.
At Victoria's highest court, we aim to deliver a judgment and historical turning point, in turn, providing some protection for everyday Australians on Facebook from lawsuits over the comments and actions of others, while also driving the agenda our country needs for overdue social media law reform.
