Hey friends, I would love your help to correct a terrible injustice. My dear friends, Ray and Bonnie Ferguson, have been foster parents for over a decade, fostering more than 30 children, many with complex medical issues. In addition to their biological children, they have adopted seven from foster care. Several have special needs. They not only pour their lives into their children, though. They also provide support to other foster families. They have the biggest hearts!
Last year, they were blessed to purchase what they hoped, with some work, would be their dream home. That dream would soon turn into a nightmare. In May 2023, they hired a contractor to install a concrete driveway to accommodate their 15-passenger van and provide a safe place for their children - several who have mobility issues - to play. This was a huge expense for the family, but one they felt necessary to help give their children a safe place to play. In spite of the significant time they spent researching contractors, checking reviews, and receiving estimates, they chose wrong. The contractor they hired framed their circular driveway with 2x4s, the driveway cracked in multiple places within days, the control joints were cut in wavy lines and the crew dropped the saw on the uncured concrete - there was a whole list of issues. When they requested that the driveway be corrected, the contractor canceled the contract, leaving the driveway not only in what the family believed to be unsatisfactory condition, but also unfinished so that the family had no vehicle access to their home. In spite of this, they worked with the contractor to negotiate a final payment. Having already made an initial payment before the work began, they then made this final payment, and the contractor stated in writing that the contract was paid in full. An itemized statement showed the payments made included all the concrete, other materials, permit fee, and site preparation.
In December, Ray and Bonnie were shocked when they were served a lawsuit by the company who provided the concrete for the driveway, foreclosing on their home. In spite of being paid for the concrete by the Fergusons, the contractor had failed to pay the concrete company. Unfortunately, it appears that in order to keep from losing their home, they will need to pay for the concrete a second time, and then attempt to sue the contractor to recoup those costs. I cannot believe this is the outcome. Who would expect to have to pay for a new driveway twice?
Please help me in supporting them, so they and their children can avoid losing their home!
