Fund Mr. McClellan's Legal Battle and Library Project

  • I am broke, homeless, and in debt. I live in a tent. I cannot get a bank account because I am homeless and can’t receive any funds.
  • Imagine living in a community where, if you seek justice, the very foundation to defend yourself is out of reach. In South Lake Tahoe, CA citizens face just that: no local public law Library, and only limited access to legal resources. Without comprehensive sources of legal resources, the public is denied access to knowledge they need to defend themselves in court leaving them vulnerable in a hazardous jurisdiction. I'm seeking funds to change this. My vision is to build and design a full-fledged, accessible public law Library, where everyone-from students aspiring to practice law to citizens needing professional guidance-can find support and resources. Due to the exorbitant cost of real estate I will purchase a 3D printer to minimize construction costs, this Library would offer the community a space to learn, grow, and seek justice. It’s not just about books and resources; it’s about empowering every resident to access the justice we all deserve.

Let’s build something that empowers our community for generations! I also need funds for housing, that is why I think $20,000,000 may not be enough in the 'land of greed'.

I have a very unique active personal injury case (CV240607) involving three different law enforcement agencies in El Dorado County (So. Lake Tahoe). The first cause of action was by local P.D. (fraudulent traffic collision report; no attorney will take my case due to being found at fault); the second cause of action was the C.H.P. issuing me a CHP 422 Vehicle Check/Parking Warning/Highway Damage Report for having a tent in the forest! (not public nor private property). Then, E.D.S.O. gives me a Notice of Trespass on Private Property; they even gave the forest an address! The third cause of action is E.D.S.O taking my tent, sleeping gear, chair, stool, mattress, lantern, bug zapper, and other items (8-person tent). My personal property was "booked" for safekeeping. They claim I had too much to store in So. Lake Tahoe (taken to Placerville). They also know my bike is my car! Placerville is 60 miles down a mountainside one way.

Below is the recommended citation for the U.S. Sup. Ct. cases for being homeless (City of Grants Pass, Oregon V. Johnson and Martin V. City of Boise, No. 15-35845 (9th Cir. 2018). I am now homeless and cannot afford housing. The police took all of my camping gear. Also, no Christian church will help me with housing!

I love Justice Sotomayor. In her dissent, she states: The majority reaches the opposite conclusion, Sotomayor argued, by misunderstanding Robinson. The ordinances at the center of this case “criminalize being homeless,” she wrote.

Moreover, Sotomayor suggested, the majority’s concern that upholding the lower court’s ruling would create too many “difficult questions,” such as whether someone is “involuntarily” homeless, is unfounded. “Ultimately,” Sotomayor said, “these are not metaphysical questions but factual ones.” But in any event, she continued, “[j]ust because the majority can list difficult questions that require answers does not absolve federal judges of the responsibility to interpret and enforce the substantive bounds of the Constitution.”

Sotomayor wrote that she “remain[ed] hopeful that someday in the near future, this Court will play its role in safeguarding constitutional liberties for the most vulnerable among us,” but that, in her view, the court “today abdicates that role.”

After reading the cases, I have come to the conclusion that I have a case for the High Court to adjudicate (I know I have Justice Sotomayor on my side!).

The Sup. Ct. of the land has criminalized a biological need for sleep. It is now illegal to be homeless or not to have a place to sleep.
