On Tuesday September 5, 2023, Victor checked in with his immigration probation officer at an El Paso County office. To his utter shock, he was notified that Immigration and Customs Enforcement (ICE) would be arriving shortly to deport him to Ciudad Juárez, Mexico. Victor was deeply confused since one week prior, on August 29, 2023, he had received legal notice that his case—from 2019 for “illegal reentry”—was fully dismissed. Because of the way in which the Immigration courts system and the U.S. criminal courts systems are separate, it did not matter that Victor’s case had been dismissed. According to ICE, he was deportable and that was exactly what happened next.
The caveat is, Victor is a U.S. citizen—but he does not have “proper” documentation to prove this fact. During his case in 2019, Victor hired a private investigator (PI) to prove his legal status as citizen. His PI was able to confirm that Victor is legally a citizen but without the proper documentation to prove this fact he has navigated his life as an undocumented person in the US.
Victor is currently residing in Ciudad Juárez, Mexico with his wife while they process the recent events and seek resolution via a lawsuit against the U.S. court systems. Victor currently has legal representation and has been notified that in order to bring a lawsuit for civil rights violations against the U.S. courts, he will need to produce $7,000. This gofundme seeks to raise the funds to pay for his legal representation and a lawsuit that restores his rights as a U.S. citizen.
