Gately Oaks and Quinlan neighborhoods are currently in a rezoning battle with the owner of 16 acres located in the heart of our subdivisions (see photo). This land is currently zoned Residential Rural ( 1 acre lots) and owner is seeking to rezone to RLD-90 ( 90 x 110). Stopping this rezoning is of great importance to all of our neighbors as it would add approximately 320 additional car trips per day on already crowded roads.
Gately Oaks Unit IV is facing a costly legal battle with Fort Caroline Development who purchased a house on Gately Oaks ln E in 2018 with sole intent to claim Developer rights and demolish the house and build an access road to a 32 home neighborhood. This is critical to the rezoning because access alone through Quinlan has been shown to be unviable and rezoning should be denied as per previous attempts to rezone. The only way it can be developed to RLD-90 would be if we lose the lawsuit and they build the proposed plan via Gately Oaks ln E.
The property rights of a Developer are given during the initial construction and sales period and when all lots are developed, management of the association is transferred to the HOA. This happened with Gately Oaks IV in 2001. Ft Caroline Dev actually was out of business between 2007 and 2018, just prior to purchasing the property on Gately Oaks ln E. Let's pray our judicial system is not so corrupt that a scheme so transparent that seeks to use the letter of the law vice intent of the law will be quickly dismissed.
Gately Oaks IV HOA is a small subdivision of 64 homes, that has already been forced to spend a large sum of money to protect the subdivision from this blatantly unfair action. We all should be outraged at the injustice being perpetrated. If this can happen in our neighborhood, what is going to stop something like this in others. WE CAN EITHER ROLL OVER OR STAND UP AND FIGHT! We are choosing to fight this action and are asking our neighbors for VOLUNTARY CONTRIBUTIONS. No amount is too small and ALL will be appreciated greatly. We thank all in advance who choose to give. The more donors, the more impact, as we show solidarity.
