Help Angel Benito with Immigration Legal Expenses

Dear Family, Friends and Community,

We have supported Angel and his mother, Maricela Santos, for the last four years. Angel is a young immigrant, 33 years old, an activist, leader, father, son, brother, friend, and a close De-Bug family. At a young age, he was very active within the Redwood City community. Angel volunteered in Project Read, reading books to local elementary school-aged children to promote reading and learning in young kids. He also participated in cleaning the environment in his community, picking up litter from the streets and nearby beaches.

Maricela has supported her son years back in the difficult legal battle of remaining in this country with legal status. Previously, Maricela’s employment was able to help sustain the legal costs of his case. Unfortunately, with the loss of her job, she finds herself with the tough necessity of asking for community support to continue reunifying her family.

Angel has 3 U.S. Citizen children who constantly ask for him as he was detained in December 2015 and in March of 2021, unfortunately, deported and torn apart from them. In Maricela’s words, “How can I, as a grandmother, explain to my grandchildren that someone who wasn’t born here is subject to deportation, if in a child’s innocence there’s no barriers and deportation is a word they’ve never heard but can be very painful without even knowing its meaning.”

About six years ago, Angel submitted a U visa application as a derivative, and barely in July, he received a letter from immigration requesting more information. Although we are uncertain whether this immigration relief will be granted, we believe it is necessary to exhaust every possible option and keep fighting. It was difficult to secure a private immigration attorney to represent Angel in responding to his U Visa; though we contacted several community legal organizations and other private attorneys, his case was complex and beyond their expertise. A large majority of them decided not to take Angel’s case. That is why we find ourselves in this situation to ask the community for support to pay the high cost of the attorney fees, the only attorney that dared to represent him and leaving us out of options to seek someone more financially feasible. A portion of these funds will also help cover the travel expenses to be able to be present at his next court date.

Angel is currently at the Otay Immigration Center in San Diego since he fled Mexico a second time after his deportation, seeking his safety and running away from constant extortion and threats from the police patrolling the area he lived in.

Community Involvement and Contributions:

Angel consistently joined our weekly San Mateo County Participatory Defense meetings via zoom and supported other families in their legal and immigration court process. He contributed ideas and helped strategize during campaign meetings. The distance was not an obstacle for him to continue fighting for immigrant rights and pave the way for others. He advocated for the end of ICE transfers in San Mateo County to prevent other families' separations. His courage and powerful story influenced the Board of Supervisors and the County Sheriff to finally stop ICE transfers from county jails in Nov. of 2021. His advocacy expanded across California with AB 937 - the VISION Act, which would end ICE transfers from county jails and prisons. Angel shared his story with MiJente at a National Forum to hold President Biden’s Administration accountable within the first 100 days in office and demand DHS Secretary Mayorga stop deportations.

Maricela’s only hope is to have her family reunited and that Angel can remain in this country to see his children grow up with him so that the same story does not repeat itself since Angel never had a father figure.

We trust that the community they have lived in for over 20 years will not leave them alone.

Hemos estado apoyando a Angel y a su mamá, Maricela Santos, en los últimos 4 años. Angel es un joven inmigrante de 33 años de edad, activista, leader, padre, hijo, hermano, amigo, y una familia cercada de Debug. Desde muy joven, estuvo involucrado dentro de la comunidad de Redwood City. Angel participo en Project Read, leyendo libros a niños de escuelas locales elementales y así fomentar la lectura y aprendizaje en niños pequeños. También participó limpiando el ambiente en su comunidad, recogiendo basura de las calles y playas cercanas.

Maricela desde años atrás ha apoyado a su hijo en la dura batalla legal de permanecer en este país con un estatus legal. Anteriormente, el trabajo que tenía Maricela solventaba los gastos legales de su caso pero lamentablemente, con la pérdida de su trabajo se encuentra en la dura necesidad de pedir apoyo de la comunidad para continuar con el proceso de reunificar a su familia.

Angel tiene 3 hijos Ciudadanos Americanos quienes constantemente preguntan por él, ya que desde Diciembre del 2015 ha estado detenido y en Marzo del 2021, lamentablemente, fue deportado y alejado de ellos. En las palabras de Maricela “¿Cómo puedo yo, como abuela, explicarles a mis nietos que alguien que no nació en este país está sujeto a una deportación, si en la inocencia de un niño no hay barreras y deportación es una palabra que ellos nunca han escuchado pero que les puede hacer tanto daño sin siquiera ellos saber el significado?”

Hace 6 años Angel sometió una petición de Visa U como derivado y hasta apenas en el mes de Julio recibió una carta de inmigración solicitando más información. Aunque no sabemos con certeza si este remedio migratorio le sea otorgado, creemos que es necesario agotar todas las opciones posibles y seguir luchando. Fue muy difícil asegurar un abogado de inmigración privado que pudiera representar a Angel en responder a su Visa U aunque contactamos a varias organizaciones legales comunitarias y otros abogados privados, su caso era muy complicado y fuera de sus habilidades. La gran mayoría de ellos decidieron no tomar el caso de Ángel. Razón por la cual estamos solicitando apoyo a la comunidad para solventar los altos costos de los honorarios de un abogado, que se atrevió a representarlo dejandonos sin opciones de encontrar alguien más económico. Parte de estos fondos también ayudarían con los gastos para viajar y poder estar presente en su próxima corte.

Angel actualmente se encuentra en el Centro de Inmigración de Otay en San Diego, CA ya que huyó de México una segunda vez después de su deportación, buscando su seguridad y corriendo de la extorsión constante y las amenazas de la policía que patrullan la área donde vivía.

Participación Comunitaria y Contribuciones:

Angel se unió constantemente a nuestras reuniones semanales de Defensa Participativa del Condado de San Mateo atraves de Zoom y apoyó a otras familias en su proceso de corte legal y de inmigración. Él contribuyó ideas y ayudó a elaborar estrategias durante las reuniones de campaña. La distancia no fue un obstáculo para que él continuara la lucha por los derechos de los inmigrantes y forjara un camino para otros. Él abogo por el fin de las transferencias de ICE en el Condado de San Mateo porque quería evitar la separación de otras familias. Su valentía y su poderosa historia influyeron a la Junta de Supervisores y al Alguacil del Condado a finalmente detener las transferencias de ICE desde las cárceles del condado en Noviembre de 2021. Su defensa se expandió a través California con AB 937 - La Acta de la VISIÓN que pondría fin a las transferencias de ICE desde las cárceles del condado y las prisiones. Angel compartió su historia con MiJente en un Foro Nacional para responsabilizar a la Administración del Presidente Biden dentro de los primeros 100 días en su mandato y exigir al Secretario del Departamento de Seguridad Nacional Mayorga parar las deportaciones.

La única esperanza de Maricela es poder tener a su familia reunida y que Ángel pueda quedarse este país y pueda ver crecer a sus hijos junto a él para que no se repita la misma historia ya que Ángel nunca contó con una figura paterna.

Confiamos en que esta comunidad donde han vivido por más de 20 años no los va a desamparar.
