In 2008, Luke Scarmazzo was sentenced to 22 years in federal prison for operating a state compliant medical cannabis dispensary in Modesto, California from 2004-2006. He was charged under a kingpin statute despite the fact that Luke was following state law and that there were other dispensaries in California that weren’t being prosecuted.
On February 3, 2023 Luke was finally released from prison after serving 14 years in federal prison. A federal judge concluded that Luke would not be prosecuted federally today because of the dramatic changes to the legal landscape around cannabis, especially in California.
Leaving prison after serving 14 years can be extremely challenging, especially for someone like Luke who should have never been prosecuted in the first place. But his suffering helped pave the way for legal cannabis, which is why we are asking you to help Luke get back on his feet.
