Help Small Business against the Big Shark OCADO

Hi, my name is Robert Kalibala, a Ugandan immigrant in UK. I am a CEO of Orgacado Limited, a small startup company that supplies organic fruits and vegetables grown on our farms in Africa. I set up this company in 2018.

The name ORGACADO started from University while pursuing a PhD in Medical Science. All African origin descent PhD students at the University we organised a gathering to brainstorm how we can use our education and collective thoughts to tackle food security crisis and food sustainability in the African continent after influx biotech companies to Africa, changing the natural and organic farming introducing seedless crops such as seedless tomatoes, oranges, grapes, mangoes corn avocados and many more.

My question was how can I use my education to save the fruit (avocado) in particular which means a lot to me because at my parents house we have big soft-skinned seeded avocado trees, which produces lots of fruits year after year to feed both humans and wildlife. I had to sell avocadoes in local markets inorder to get money for my school fees.

An attack on the avocado fruit by the tech company introducing seedless avocado was heartbreaking to me. This forced me to abandon my medical career to join organic farming business of big soft skinned avocados my intention was to save the existence of the fruit from extinction. I therefore combined these two names together to derive ORGACADO.

"ORGA" - mean Organic
"CADO" - means Avocado

I decided to start importing these beautiful, huge avocados and supplying them to my growing list of customers that I had. In 2022 I applied to the office of registrar of patents (IP office), for patent of my company.

After a rigorous process, I was able to successfully lodge my Trademark application. It was to my utter shock that on June 2022 I received a letter from the Intellectual property office informing me that OCADO a UK based online suppermaket company that delivers goods was opposing my patent. They used their financial muscle to lodge an application against me. Being a one man van start up company, I was not able to successfully match them up as I was representing myself. On the 16th October 2023 the had down a judgment confirming that Ocado had been successful in the case without putting into account that these two companies are completely business wise

- Different niche market

- Different customer base

- Difference customer class

- Different Customer base (Ocado customer base more than 1 million customers and half a million customers on the waiting list.

- Different items sold (one is suppermaket and the the other is importer Exporter / farmer.)

- Different business concept and model.
Orgacado we grow our own organic food and export it from Africa to Europe.

The reason why I decided to start a Gofund page was to ask for help to fund my legal costs in the appeal that I'm about lodge to the High court. I want to find proper legal representation to help me appeal this unfair decision reached by the tribunal. I ask that you help me to level the playing field in this Goliath Vs David Battle.

I ask you to help me fight back against the domination and bullying by big corporations. I do not have the financial muscle to fight thr big shark Ocado, but together WE CAN. It takes a village. Because I believe the market is big enough for everyone.
