Help the Azizes stand up against HOA's tyranny!

Hi, my name is Gladys Aziz, a wife and mother of 5 beautiful children (ranging from 17 to 4 years old), and we live in the Heatherstone community in Harrisburg NC. My husband and I are raising money for legal fees due to a legal defense case against our HOA’s (Home Owners Association) injustice. This struggle began 5 years ago when the HOA selectively and discriminately accused us of three alleged violations on our property. First violation, when we built an "HOA approved" small retaining wall, they accused us that a portion of it was 6 inches above the approximated measurement given originally. The second violation was for adding a concrete base to a very small portion that needed support when installing an "HOA approved" fence. The third violation was for installing the "HOA approved" fence on our property line, which they considered was too close to the street. We adamantly disagree with these violations, and we have won two of the alleged violations in trial and are still fighting the third one to this day in the appellate court.

We have thoroughly researched and read the community Covenants & Restrictions, Architectural guidelines, and the state general statutes, and we legally confirmed we didn't break any rules. We have tried multiple times to reach a settlement but to no avail. Instead, they insist on continuing litigation until they recover all attorney fees currently reaching over $100,000 and other HOA fines by trying to foreclose our home. HOA has been given so much power, creating a real bad impact on families; for sure it has damaged our family and negatively impacted our kids and their trust within the community in their more vulnerable years of their life. Our kids have been subjected to racial and physical aggression around the neighborhood and in their school bus. Also, the HOA have stopped us from enjoying the community pool even though we are paying our dues. HOA has taken away our rights to enjoying OUR house that we are paying for, as well as our peace, our tranquility, and my kid’s emotional stability. We feel our constitutional rights have been violated; but we just can’t give up on perusing our happiness. What would you do if you were in our shoes? How long is the HOA going to harass families? Enough is enough! We need to stand up to this high scale bulling and say no to injustice!

We never thought we would get to this point where we would have to ask for financial help, we've been covering our highly expensive attorney fees from all available recourses, but we have hit a financial road block. The HOA has a bigger pocket, but we can't give up on our home or our rights to say no to tyranny. This is why we are reaching out to you, and time is running out for us.
