Hemp Flower Legal Defense Fund

The New York State Department of Health (NYSDOH) has proposed banning the sale of Hemp Flower in New York State. This proposed regulation would deny countless farmers an opportunity in the hemp market which has - up until now - provided shared opportunity for farms and other businesses of all sizes; this would also lead to losses for NYS retailers and denial of choice to consumers. 

Your contributions will go towards pursuing a lawsuit against the NYSDOH for an injunction to allow the sale of Hemp Flower in NYS. The first round of fundraising is going towards drafting and delivering a legal complaint. This is not a publicity stunt or merely an attempt to extract some vague concessions from NYS; this is a serious legal case that - once initiated - has the law on its side, and has an outstanding legal team to bring about meaningful changes for our industry.

Joseph Levey is a Founding Partner Helbraun Levey and oversees all New York State Liquor Authority and other licensing matters for the firm. Joseph’s primary area of expertise is New York State Alcohol Beverage Control Law and he has extensive experience practicing before the New York State Liquor Authority with regard to various licensing and disciplinary matters.
