Landlord Class Action Struck Out-Need 269 Partners

Private housing providers have been egregiously taken advantage of and have not been able to receive access to timely justice due to significant delays in processing at the LTB (PLEASE SEE UPDATE 1 BELOW). This has resulted in many cases of owners losing control of their properties, suffering damages, lost revenue and incurring debt due to non-payment of rent, or not being able to regain possession of their property for their own use. The LTB is supposed to be the de facto mechanism for dispute resolution in a timely manner, and has failed to provide a minimum or any reasonable level of service to applicants.

The LTB requires much-needed reform and this is an important step and opportunity toward the improvement of how this provincial organization operates.

In the claim, I assert that the Ontario government, through its misregulation of the Landlord-tenant relationship, has effectively deprived me - Elsie Kalu, the Plaintiff and potentially thousands of other Ontario Landlords, of all reasonable uses of their rented properties. I further assert that this amounts to the de facto expropriation (“constructive taking”) of our lands by the Government – something a recent Supreme Court ruling describes as giving rise to a right to compensation. 1

The proposed class must first be certified by the Court before the claim is permitted to proceed. Following certification, all individuals who are members of the class will be automatically included in the claim.

Marshall Law Firm has submitted the Statement of Claim and has spent many hours preparing the initial legal documents. However, there are costs to do this and there will be more costs in the future to pay for disbursements, motions etc. If you want to see change and would like to contribute to having this case move forward, contributions will be accepted at a minimum of $50.
