Lawsuit to Save SEVIS Status for All International Students
Donation protected
The US government is terminating hundreds if not thousands of international students' SEVIS registration without legitimate reasons. This has wreaked havoc on the students' study and life in the US. With the termination, the international students are supposed to leave the country right away. The only solution is to get a court order to restore their SEVIS status immediately.
To speed things up, we are filing a lawsuit now with a goal to restore and save all affected students' SEVIS status, and we will request a court order in the coming days. This lawsuit is not just for one or two international students. Our objective is to stop the government's unreasonable termination of the SEVIS status to benefit all international students.
To litigate a case against the federal government is very expensive. A case like this can easily cost several hundred thousand dollars in legal fees. If the case is appealed to a higher court which is normal in this type of lawsuits against the government, the fees can significantly increase.
Because of the public interest nature of the case, we represent the four plaintiffs for free and will not charge them any fees. However, there is a huge cost to our law firm by devoting so many attorneys to the case on an emergency basis. We expect the initial stage of the case (preparing the complaint & filing the case and applying for a court order for a temporary restraining order) will cost at least $150,000. If we don't reach the fundraising goal by the end of April, we may be forced to scale down the case.
Given the urgency of the matter, we have filed a lawsuit in a federal court on April 11 and a motion of more than 600 pages to request a court order on April 15. The judge has decided to hold a hearing on April 21, and a decision from the court will likely come out several days after the hearing. If the court order is favorable, we may be able to restore SEVIS status for all affected students. To ensure everyone's informed, we will publish the updates and key court files at www.caseforf1students.com.
We are DeHeng Law Offices PC, a law firm based in the San Francisco Bay Area, and we are specialized in going after federal and state governments in court to protect minorities and disadvantaged people. For example, our attorneys successfully sued the Trump administration for its WeChat ban and obtained a court injunction that stopped the WeChat ban in 2020. Our attorneys have also worked on other high-profile cases protecting the rights of international students; for instance, we recently won an injunction against a Florida law (SB 846) that bans the on-campus employment of international students.
