We are a group of neighbors concerned about High Density Residential (HDR) re-zoning that is imminently happening in our quiet countryside neighborhood, unless we raise our concerns through the appropriate channels. There is a deadline of October 7th, for comments on the Draft Environmental Impact Report (DEIR), which means we have a short timeframe to enlist the help of experts to engage on our behalf on this incredibly pressing issue.

The Bishop property (1806 Monticello Road) located along Hedgeside Avenue is currently shortlisted as one the properties of the Housing Element Update to be re-zoned for High Density Residential living, opening the door to 100 individual units being developed on the site. Most alarmingly, it is one of the two properties recommended in the "alternatives" section of the latest DEIR, which recommends rezoning BOTH sites. Many neighbors have already voiced their concerns about developing the site to the County, including: high fire risk, high fire insurance cost, fire evacuation impact, environmental impact (watershed & endangered species), flooding of Milliken creek, lack of sidewalks, lack of public transportation, lack of water/sewage pipes, drought conditions for homes on wells.

However, these concerns seem to have been ignored in the latest DEIR , which recommends in the "alternatives" section (page 496, section 5.3):

  • "This alternative would update the County’s Housing Element in the same manner as the proposed HEU, but would eliminate the Altamura, Foster Road, and Imola Avenue sites from the housing sites inventory. No General Plan or zoning changes would be pursued to accommodate multi-family housing on these sites, the land use and zoning designations currently in place would continue, and any development on the sites would be subject to policies and standards that currently exist. Only the Spanish Flat and Bishop housing sites would be designated for multi-family development under this alternative."

To maximize our chances of saving the neighborhood, we are engaging Paul Hastings, a highly reputable law firm in San Francisco that has experience with these issues. Once engaged, their recommended strategy is to research and write a letter to be submitted by the October 7th deadline, engaging experts to integrate both legal and environmental perspectives in the letter. Their estimate of the work involved is 100 hours, and at their billable rate of $1,000/hr (typical for highly reputable law firms), this comes out to $100,000. This is our fundraising goal. Any unused funds will be refunded pro rata.
