This whole ordeal started when they raided our peaceful church on 11/11/24 and took our ceremonial and healing mushrooms. But we stood up for ourselves in court, and on Friday the 13th of Dec. 2024 the federal judge correctly ruled that we are sincere, safe, and likely to win this whole case - but only if we can hold our ground in the meantime.

This marks the first time in U.S. history, a federal judge ruled in favor of psilocybin therapy, she issued an actual restraining order against the government, protecting our clinically influenced ceremonies under religious freedom laws. This is a big deal. After two full days of emergency hearings wherein the federal judge listened to evidence and testimony, our judge granted us a historic win (more details on our website).

But the local government refuses to accept this. Instead of respecting the court’s decision, they are trying to bury us in legal fees, manipulate the system to get a new judge ("forum shopping"), and overwhelm us with retaliatory charges and new filings in different courts.

This isn’t just about us. This is a fight for the future. This case sets a legal precedent for every sincere religious group that uses entheogens for spiritual and healing purposes. Winning means ensuring that safe, structured, and clinically supported psychedelic therapy remains legal, accessible, and protected.

The Government Is Trying to Shut Us Down—But the Courts Are On Our Side

The federal judge saw through their tactics and ruled in our favor, even issuing a Temporary Restraining Order (TRO) against the government to stop them from interfering with our religious practice.

In different events the judge called the local government’s actions “harassing”, “ironic”, and “mystifying.”

Our federal judge stated that the local government:" must apply its protections equally to unfamiliar religious groups as to familiar ones if their commitment to religious liberty is to mean anything." our Judge went on to say it is "ironic" that the state of Utah is "so vigorously deploying its resources, particularly the coercive power of its criminal-justice system, to harass and shut down a new religion it finds offensive practically without any evidence that that religion’s practices have imposed any harms on its own practitioners or anyone else." - Judge Jill Parish Feb. 20th, 2025

She then ordered something happened that has never happened before in U.S. history—the federal judge ordered law enforcement to return our sacred mushrooms. They tried to protest and stay the order, but she made the ruling a second time. They were forced to return them.

This was a landmark victory, and we tried to settle with them for small amounts, but this local government just doubled down, and is fighting back harder than ever. They are now trying to forum shop, a dirty legal trick where they attempt to get the judge removed from the case because they don’t like her decisions.

This is not just a lawsuit anymore—this is a war over the future of psychedelic therapy, mental health treatment, and religious freedom.
