Luke’s Awareness

My name is Candi Payne currently residing in Los Angeles Ca. I am viciously fighting a child custody battle for my 14 year old son Luke who is currently residing in Bakersfield Ca, with his biological father Robert Moseley. I’m asking for help in any way possible please, donations,counseling, child protective services, law enforcement, lawyers, and prayers during Luke’s Awareness. I’m opening up to the public for the first time and asking for others to be concernd to become involved for my son Luke’s Awareness. There are several police reports from Bakersfield police, kern county sheriff’s, hospital reports, child protective services reports (CPS) from the county of Kern in Bakersfield Ca, who are allowing this type of abuse and misconduct to continue, they are not advocating for Luke. Each outcome is unfounded. The last regular visitation schedule I had shared with Luke was 3/23/2017. I picked Luke up on a Friday in Bakersfield for our regular weekend visitation and I noticed Luke had bruises and ligature marks around his neck. Luke told me, “My father choked me, and kicked me, then locked me outside in the cold around 10pm for hours throughout the night.” Returning to LA I called 911 the LAPD instructed me not to release Luke to his father. In fact if his father would have came to LA to pick Luke up, I was to call the LAPD who would’ve arrested him. His father never showed, two weeks later he filed and ex-parte in Bakersfield Ca. Then I had a mandatory appearance to be in the kern court, so I brought Luke to court with me. His father told the court I kidnapped Luke and was keeping him out of school and not medicating Luke with his ADHD medication. I asked his father many times to comply, but he failed. Ive tried to comply with him, because I knew it was the best decision for Luke. His father failed to comply with giving me any medication, or school records so that I could medicate, or enroll Luke into the Los Angeles school district. Upon arrival into the kern county court the judge ordered me to release Luke temporarily with his father, until there was to be a hearing. I was put on supervised visitation at $70 an hour 2nd,4th,5th Saturdays for a 6 hour visit. Luke began screaming, shouting using profanity towards minors council and at the judge, “F*#€ this I’m being abused and no one is doing anything about it, someone please help me, I’ll run away, or kill my self.” Everyone ignored Luke’s Awareness. The judge ordered me to go outside and calm Luke down, attempting to do so, Luke and I were in the hallway sitting on a bench in the general public. Just then 4 sheriffs grabbed Luke and I aggressively, and used physical force on both of us and detained us both in handcuffs, because I would not leave and abandon Luke alone In the court house. I could hear my child Luke kicking, screaming, “your hurting me! Stop! Please stop! I want to go with my mother! I’m being abused!” In that moment I knew Luke and I were in serious trouble and we really needed help. I was arrested for contempt of a court order, resisting arrest, and obstruct on an officer. I went to jail they took Luke away. A CPS worker visited me in jail, CPS told me Luke’s case does not rise to the criteria of the level for what they will consider to be child abuse in kern county. I’ve only been allowed to visit my son a total of 8 times since 12/2018. The judge has denied me phone contact. I hired a lawyer Leslie Richards who has done nothing but collect money and put numerous continuous’s on our case. It was brought to my knowledge by California state Bar that Richards has been suspended for her negligence on many other victims. Since the misconduct of Richards she suggested another a temporary lawyer to fill in who appeared in 9/2019 where I was rearrested again for an outstanding warrant for a failure to reappear in 05/2018 on the criminal case that the sheriffs arrested me on in 4/3/2017, because Richards failed to communicate with me about any appearances needed. Also,minors council was taken off the case causing more continuous’s. The court assigned a new minors council Stephanie Childers, who was not familiar with our case so she needed continuous’s. The last appearance was 12/5/2019 where the judge saw me in court again without a lawyer. Minors council said at this time her fee was at $1800 and the judge sanctioned me due to the continuous’s to pay before our next court appearance, which was in less than a week away. I need to continue to fight for Luke as a mother and advocate for my son. Kern County is neglecting and ignoring the fact that Luke has been being abused. I’m disgusted, and devastated that this system is neglecting children and including my child Luke. Kern county has proven to be one of the highest levels of evil corruption and multiple children being abused in the worst form throughout the judicial system. Please help me protect my child.
