Michael of Pas, CA Illegally Arrested & Battered!

Below is an account of my dad's illegal arrest and excessive force incident with the Temple City Sheriff's Department on Friday, Dec 30th, 2022.

By the way, both our names are the same, my dad is Michael the 2nd and me the 3rd.

"I was going to a restaurant with my family for lunch. We had just parked the car at our destination when we heard a large number of sirens. We then saw a homeless man slowly pushing a shopping cart right in front of us on the sidewalk. Then all the sheriff's vehicles came to a screeching halt and started yelling at the homeless man to stop while pointing their weapons at him. At that time we decided to start recording the encounter on our phones.

The police claimed that he was swinging a bat at someone so they eventually arrested the man and placed him in one of the vehicles on the street. I thought everything was over but continued recording while heading to the restaurant along with my family following just behind me. One of the sheriffs had parked her car in the parking lot where we were watching the arrest. While walking towards the restaurant I heard a noise coming from the sheriff's car so I turned the phone towards the car, then I heard the female sheriff scream out "hey, arrest him!" "are you taking pictures of our car?" She was referring to me. The group of sheriffs about 50 feet from away charged at me and started to attack me like savages to put me in cuffs. I'm 57 years old, overweight and was not moving. I was injured during the illegal arrest so I requested to go to the hospital for treatment.

One of my family members caught the arrest on video. The sheriffs kept trying to prevent my family member from recording my arrest."

After his arrest, my father was taken to USC Arcadia Hospital, where he was supposed to receive treatment due to his injuries from the Sheriffs. He was disgracefully discharged from the hospital after approximately 30 minutes of waiting to be seen. He was never evaluated by a doctor. His only treatment was one Ibuprofen tablet. Then he was taken to the Sheriff's station and falsely charged with "Obstruction 148(A)(1) PC /M/ OBSTRUCT\ETC PUB OFCR\ETC".

He was released at around 8:30 pm and then went to a different hospital, Huntington Memorial Hospital in Pasadena. "Diagnosis; Sprain of left shoulder, initial encounter. Imaging Tests x-ray shoulder left 2 views/more" They also gave him a sling for his arm, 2 prescriptions for pain and instructions to make an appointment with his doctor.

His arraignment date was Feb 28th, 2023. He went to court and found out that the DA declined the charges! My father is currently unemployed and looking to use the donations for medical bills, and other unforeseen expenses.

He is still looking for a civil rights lawyer to sue the LA Sheriff's Dept. Assistance in referring him to a lawyer would be greatly appreciated!
