Rebecca & I met over a decade ago, just when “online friends” were becoming acceptable. As part of a small, but loud, military spouse blogger space, we connected through our similar beliefs in a community that was not very accepting of us … and to this day, she has remained one of my closest, and greatest friends. She is an amazing mother to two children that she adopted with her now ex-husband, works tirelessly to support herself and her kids (one who is Austistic, and another who has recently come out as Trans), and continues to be an amazing and uplifting human for her family, friends, and anyone who knows her.
Rebecca, however, is also a survivor of domestic abuse and assault. For years, her ex-husband mentally and physically abused her, held her at gun and knife-point on multiple occasions, cheated on her repeatedly and stole their joint funds for his own personal uses. Oftentimes the physical altercations occurred in the presence of their two (at the time) small children, leaving them with their own trauma that Rebecca has worked tirelessly to help them through since finally having the strength to kick him out of their home in October of 2015.
Late last year, Rebecca’s abuser hired a lawyer and is now trying to force the sale of this home. Doing so would remove Rebecca and her children from a home that is stable and safe for her and the very specific needs of her children. During the hearing process, her abuser agreed in the magistrate's presence that Rebecca could refinance the home on her own (which she was already in the process of doing) that he would back down.
However, much to the shock of us all, in the process of waiting for her abuser to sign the necessary paperwork, the magistrate recommended in favor of her abuser, and that the home be sold. Part of the magistrate's recommendation was that Rebecca had two choices: either sell the home and move, or have first rights to purchase the home from herself (refinancing into her name only is no longer an option). Since her abuser's departure from their home in 2015 (which they purchased in June of 2012), Rebecca has maintained and paid the mortgage on her own for her and her children, with no help or payment from her abuser. She has also put in extensive work and money to improve the living condition of the home, and raise the property value extensively since her abuser’s departure. Rebecca and her attorney have filed an exception and are expected to go in front of a circuit court judge.
**Staying in this home is critical for the safety, stability, and well-being of her and her two children, both physically and mentally, so Rebecca is fighting to have the Judge reverse the position, allowing her to continue the refinance of the home so that they may stay.** Any funds raised will go towards continued lawyer fees, and worse case scenario, will go towards any costs that arise from her having to purchase the home a second time. Leaving the home is not an option.
It is important to note that her abuser is tens of thousands in arrears on his court-ordered child support due to non-payment. The only payment Rebecca receives is when his wages or federal returns are garnished. Also, for a second year in a row, her ex has claimed the children on his tax returns, despite him not having seen or spoken to them in years, and prolonging needed finances that Becca relies on to continue therapy support for both of her kids. Any funds he receives from the sale of the home, would likely be returned to her, possibly displacing her and her family for unnecessary reasons.
