11/20/20 UPDATE: Hello everyone, we are updating our fundraising target to $15,000 in order to make sure we have the funds necessary to file and fight this second suit properly. The second suit is being filed in Federal Court on constitutional grounds. This is a merit-based argument against the Board of Health decision. 11/15/20 UPDATE: I’ve been asked to share a little more on this effort as well as on who I am. The group of parents who came together to launch PIPE spoke with several attorneys on Friday, Nov. 13 following the BOH vote. They all agreed that our best option at this point was to file a preliminary injunction against the order. If there is an attempt to extend the shutdowns we can put together a larger case on the merits but with just 2 weeks a preliminary injunction is the best route. - About me... my name is John Mark Niehls. I am the Head of School at Coventry Christian Schools in Sanatoga. I am a father of 5. I am fighting for my kids, for my school, and for every student under this order. Frankly speaking the kids who are hurt most by this are those with special learning needs, low-income families, families with two working parents, and especially the students attending public schools who have just started back(some haven’t yet!). - I am not a Covid denier. My mother is an MD and is treating/caring for Covid patients. I’ve lost friends to this virus. I AM absolutely committed to science and data. And right now, ALL available science and data shows this virus is not a threat to kids and young people and that it is not being spread in our schools. If this was spreading in our schools and it posed a major danger to our kids, I would support increasing the mitigation there or even shutting them down. - Please help us fight back against this unsubstantiated order that risks the health and well being of our children. -
ORIGINAL POST: On Friday, November 13th the Montgomery County Board of Health voted to force all K-12 schools in the county to close down. This order was approved hastily and we believe is problematic on many fronts. Our first effort is to file a preliminary injunction to have the order thrown out on procedural grounds. We have several attorneys who are willing to do the bulk of the work pro bono but need $10,000 in order to make sure this case is filed promptly and properly. 100% of the funds will be used for this lawsuit.
