I am Tamera Pearson and I live off of Old County Road in Newark, DE. Our group consists of neighbors in the area who make up a community which we call The Old County Road Community. Our campaign is asking for your help to protect the Suburban Zoning Code. On January 9, 2020, the New Castle County Board of Adjustment by a vote of 6-1 granted a Virginia based company their request for a variance to build a senior living facility off of Old County Road. THIS IS NOT MEANT TO KEEP THE COMPANY FROM BUILDING. The Suburban Zoning Code dictates how many square feet as well as how high a developer can build under the Code which for the acreage of property purchased is 143,600 square feet and no taller than 3 stories/40 feet high. The NCC Board of Adjustment granted a variance to the company allowing them to build a 196,600 square foot, 4 story, 53 feet high facility. This decision has serious negative implications with respect to the specific hardships that the company's facility overages would place on the Old County Road Community (in terms of excessive traffic, storm water runoff, etc). Equally important, the Board’s ruling also has wider-ranging negative effects in terms of setting a precedent throughout New Castle County—anywhere and everywhere that commercial enterprises seek variances in Suburban Zones and claim that they can’t turn a profit to the extent that they would like if those variances aren’t granted. Please help us raise the monies which will allow us to obtain an attorney to appeal this ruling by the Board!
