As a the result of House Bill 2642, Certified Estheticians (CE) are no longer authorized to use devices such as micro current, galvanic and LED.
Last year we presented HB 4016 to fix the issue, there was no opposition but because legislators walked out, it did not pass.
We are presenting a new bill sponsored by representative Rob Noose, the text is written and we need the help of our lobbyist to move it through the legislative process.

Why can CE no longer use galvanic, micro current, high frequency or LED?
HB states Certified Advanced Estheticians can use lasers or other devices registered with the FDA, it unfortunately also means CE can no longer use “FDA registered devices”.
To resolve this conflict of scope, the attorney general wrote rule 67.
Rule 67 limits the scope of CE to the Stratum Corneum therefore CE can no longer use a device that has an action below the Stratum Corneum.
What will OEFFL bill do?
a) allow CE (certified estheticians) to use FDA registered devices that do not have a claim that indicate product penetration or some effect beyond the Stratum Basale. This will be in harmony with the Chemical peel rule # 65.
b) broaden our scope to brow services (tint, lamination, threading)
c) ask for a better representation of estheticians on the Board of Cosmetology
Why did the first amendment fail?
Although we had passed all the committees and had bipartisan support, the entire legislative session stopped because of the fight over the cap-and trade bill. Unfortunately, the representative walkout meant that none of the laws were passed.
Why do we have to pay the lobbyist again?
A lobbyist talks to all the responsible parties, helps reach a consensus, and facilitates all the committees hearing before the amendment is put to vote. George Okulitch did all this in March 2020. Regrettably, we got caught in the 2020 walkout mess and no laws were passed. We wish we could pick up from where we were but unfortunately the legislative system asks us to start from scratch, hence George has to do all the work again and be paid for it!
It is a bit easier as we know what needs to be changed and thanks to George Representative Noose will sponsor us again.
Is the amendment guaranteed to go through this time?
Nothing is guaranteed and because democrats did not pick up any seats in the House or Senate, there is no way to prevent a walk out. However, George is working to make sure our bill gets filed in the "pre session" so if the Republicans decide to walk our bill will have landed on the Governor’s desk.
How is it impacting me?
If you are already performing these services you will either need to stop and forgo a sizable income or you will need to go back to school (6 months for $15000 in tuition and no income for 6 months).
I do not use these machines, why should I care?
Perhaps you will want to in the future and as a matter of principle we need to fix this unfair scope grab and advance our profession.
What if I ignore the rule?
We have secured a waiver till June 30 2021 but after fines will put you out of business!
First offence is $2000per occurrence for the esthetician and another $2000 for the spa you work for. This means that for the first micro current service you perform after 1/1/21 you pay $2000, the second $3000, third $4000 then after 3 clients your license is revoked and you can't work anymore.
It is the same for your employer, so they will probably want to hire an advanced esthetician.
I am a student, why am I concerned?
Your tuition included learning how to use a galvanic and high frequency machine, you also are required to test for it and yet will not be allowed to perform once licensed, this is unfair.
I am an advanced esthetician in another state, how can I get reciprocity?
If you hold a current masters or Advanced esthetics license from another state you can contact the Higher Education Coordinating commission and ask for an evaluation. Estheticians may need to take areas of training that our scope in Oregon requires to be eligible for an Oregon Advanced License. You can receive credit for the training done that is equal in your state of licensure. You need to contact the Office of Academic Policy and Authorization [phone redacted]
