Russell & Lisa to help beat a bullying builder

Hi we are Russell and Lisa a normal hard working couple who set out in 2021 to build a dream home here on the GC . Unfortunately we ended up building with an unscrupulous builder who chose to ignore our approved plans and engineering. After several failed inspections the builder continued to ignore the advice of all-contracted professionals on the build (certifier and contracted build engineer) They in our opinion adopted a passive aggression stance and attempted to force us to pay for a frame and roof that was not completed and not structurally sound. We were forced to terminate the contract after years of trying to get the builder to do the right thing.

The independent engineer sent by the QBCC concluded it was “more expedient that the entire timber frame be demolished down to slab level, and reconstructed with the approved plans, AS1684 and the NCC”.

QBCC approved us to demolish the unsafe structure, which we have completed. The builder has now launched 5 different legal actions on us in an attempt to avoid his obligations. He attempts to bankrupt us so when the case actually reaches court we will not be able to afford a solicitor to stand up for our rights. We have spent $83000 on legal fees already and have ample evidence including the original approved plans, three failed inspection reports, our engineers reports and the three independent inspection reports provide by the QBCC. All of which found multiple defects and structural issues resulting in the demolition.

We did everything right and the builder has attempted to maximise his profits at our expense. Please help us stand up for what is right and just. We need assistance firstly with the legal fees and secondly trying to get back on track. We have sold almost everything of value trying to get our day in court.
