This case is about how banks SELL your mortgage and pretend they haven't, LIE to the courts and Land Registry, use FORGERIES (and claim they are "evidence") distort the truth, legislation, and case-law, to get the win "at any cost". We are currently being denied jury trials in these matters. Thomas Anthony Carlin is the former 10-yr Constable in the Police Service of Northern Ireland (PSNI) who is currently fighting the European banking giant Santander UK Plc for his family home in ongoing repossession proceedings at Belfast High court since 2010. (13 yrs)
Current circumstances:
Time is running out fast and he urgently needs the assistance of the public to pay a £10,000 security of costs order which was unfairly imposed upon him by the Court of Appeal in Belfast in late 2023 - in a legal move by Santander to block his case and prevent him from a hearing in the Court of Appeal - Northern Ireland's highest court.
He has documentary evidence and audio recordings which prove that Santander's legal team have yet again willfully lied and misled the Judiciary ( which they did in 2013 however this time the lies are regarding the legal discovery process) in order to get the case dismissed after a long 14 year battle.
Case History:
After high court proceedings in 2013 he stopped paying his mortgage payments after Santander's initial order for possession was dramatically overturned. This was after they admitted to the court that their legal team had lied in a sworn affidavit about selling his home to a 3rd party (securitisation) in order to get the possession order. Santander recommenced proceedings against him and his family in 2014. The solicitor firm RG Sinclair & Co who commenced the action have since been closed by the Law Society and an ongoing criminal investigation is being carried out by the PSNI.
In 2015 he received a "listings document" in a subject access request from Santander which showed the specific "mysterious payments" from the third party in securitisation, which had actually zeroed the balance of his mortgage - only for it to be immediately debited from his mortgage account and reinstating his balance.
He brought this document to court in a "Strike out" application in 2015 where he provided evidence of it to the court. He made an application to the court for Banker's Book application (1882 legislation) which would compel the Bank to produce all of their unedited documents regarding his mortgage loan - in order to get to the truth of the matter.
Sadly the application was blatantly ignored by the court, despite the prima facie evidence provided. Given corruption he had personally observed in other high court civil cases over a 5 yr period, the fact that banks have a 100% record in the High Courts for home repossessions and his personal knowledge of criminal law / offences, during the hearing of the judgement of the matter in January 2016 he arrested the Senior High Court Judge Sir John Gillen for 5 criminal offences including fraud by suppression of documents and Misconduct in Public Office.
He was then set upon by the Northern Irish legal system (with no assistance from his PSNI bosses) and subsequently jailed for 3 months for contempt in the face of the court. No investigation of his claims against Sir John Gillen were ever investigated. He was jailed while he was still a serving Police Officer - a very dangerous predicament in Northern Ireland's largest prison.

The newspapers reported that he had merely "attempted" or "threatened" to arrest the Judge - a claim easily disproven by the transcript / audio of the hearing.
He received threats to his life whilst in Prison.
Upon his release from Maghaberry Prison in April 2016, he lost his career when he was dismissed by the PSNI - wrongly he maintains.
In 2019 Santander's legal team lied yet again by misleading the court in order to deny him Specific Discovery in relation to the "mysterious payments" contained in the Listings document. The court directed that he was to be granted an inspection facility of Santander's computers in relation to these mysterious payments. Santander were to be given the chance to give permission in an affidavit do it of their own free will - rather than a court order. When their affidavit arrived - they actually said no to the inspection. What were they trying to hide ? Instead of the case simply going back before the judge who stated he would give an order for the inspection of the computers, Santanders legal team Solicitor emailed the court office and lied stating that discovery was over. She sent a second email 6 days later - neither of which were sent to Thomas Anthony Carlin. By misleading the court office, Santander managed to get the case moved to a new judge where their Barrister continued with the lie that discovery was over.
Two separate judges were given evidence of it but both chose to ignore it, leaving any mention of it from their judgements.
In 2022 Santander commenced the legal eviction process and Thomas Anthony Carlin submitted a set aside application to halt the repossession and nullify the possession order itself.
In July 2023, Justice Simpson found against him stating he did not have the jurisdiction to rule on key matter's. Thomas Anthony Carlin was also bereaved of both of his parents during a 4 week period in July 2023.
It is therefore only the Court of Appeal who can now rule on the matter - but Santander's legal team have used his current unemployed single parent status to gain their security of costs order, citing that he will be unable to pay costs in the event he loses the case.
If the £10k is not raised and submitted to the court by 2nd February 2024, then the case will be administratively dismissed with no route to appeal.
He also needs £2,000 funds for his minor legal costs which he currently funds from his benefits. The £2k will see the case to its conclusion. The £350 will cover the admin costs / fees from GoFundMe.
