Hi, my name is Juan Cardona. My wife Chelsy and I established Cardona’s Boxing Gym on November 1, 2017. The gym’s original location was on Morales and Colorado street. Due to the growing number of kids that wanted to be a part of our gym and our desire to help grow them in our boxing program, we made the decision to relocate as space was becoming an issue. October 2022 we relocated to our current address, 1837 Guadalupe St, 78207. We signed a contract with our landlord Joseph A., to lease for two years, November 1, 2022 until November 2024. Everything was going well. All state inspections passed and we were open for business. After serval months, around May 2023 a man by the name of Kenny Sun walked into our gym demanded we sign a new contract with him. We informed him that we already had a contract in place with Joseph. He indicated that he was the majority owner of the building and not Joseph. At that time we informed him to contact Joseph to address the issue with the contract. Given that Kenny did not provide any documentation proving he was the building owner , we refused to sign a new contract at that time. From that time until Thursday Sept 7th, we were reassured by Joseph that everything was ok. However, on September 7th, we were informed by another coach from our gym that Kenny stopped in while he was having a class, Kenny took a lock from our door and stated that if we didn’t contact him by mid-week, we would be kicked out from our place of business. We contacted Kenny on September 8th, he asked that we meet him at our gym to go over a new contract. He informed us that Joseph was no longer the landlord and that he hasn’t paid him what was owed. Kenny indicated Joseph owed him $15,000 and hasn’t paid since we moved into this location. We met with him and agreed to signing a new contract, in fear of losing our gym. Before the contract was signed, Kenny indicated that he wanted us to pay another deposit and 2 months rent. We expressed that we shouldn’t have to do that since we already paid for a deposit to Joseph. Kenny became very aggressive and asked for the unsigned contract back. He demanded that my wife and I go to Joseph‘s house and get him his $15,000. He even demanded for my wife and I to kick out the tenant that is in between my gym and Joseph‘s paint shop. We informed him that it is not our responsibility to do so. This argument went on for about an hour with no progress made. We were able to get in contact with Joseph. Joseph showed us his contract with Kenny Sun which indicates he is able to sublease. Joseph‘s contract with Kenny dates from August 2022 until August 2024. Joseph also showed us the receipt’s that he has, in fact, been paying Kenny directly to his bank account. The gym deposit was also documented on his check to Kenny. As of today we have receipts showing from January to July that Joseph has been paying Kenny. Joseph did indicate that Kenny request $1000 added to his rent once he found out he started subleasing this location to us. We feel that we have enough documentation to continue per our original contract. We shouldn’t have to sign a new contract since our contract with Joseph is valid and the contract between Joseph and Kenny is valid. There is no reason to evict us if all payments have been paid and the contract signed by Kenny and Joseph states that he is able to sublease this location to us.
If we do not sign a new contract with Kenny and come up with $5000 by this Thursday, Kenny stated that he is going to kick us out of our place of business.
We are trying to raise enough money to get a lawyer to fight this battle.
My wife did record our conversation with both Kenny and Joseph to show proof of what is going on. We also have all our contracts and receipts on hand.
We gladly accept anything you can offer to help save our gym, whether we stay at this location or relocate.
