Timeline of Events:
March 3rd 2020 - RDQ announces intent to challenge NPRM in court and begins reaching out to legal experts
March 4th 2020 - We have begun researching Freedom of Information Act Requests which would apply to this case and help our cause. Invitations have been sent out to major FPV businesses and influencers to join in the effort either by voicing their support or by giving additional funding. An official list of companies and influencers backing this will be posted at a later date.
Mid/Late March 2020 - A legal team has been formed and is immediately beginning work to research the legal issues in the NPRM, and come up with a plan of action moving forward
Summer 2020 - Initiative to include other FPV businesses is abandoned due to lack of support, case will continue to be pursued by RaceDayQuads
Early Oct 2020 - NPRM moves to its final approval step before becoming official rule
Late Oct 2020 - Legal team has invested and logged approximately 100 billable hours towards researching the case. Research is about 90% complete, and the team is awaiting the official rule to file its appeal. We are confident there is ample legal justification to pursue an appeal. The FAA has publicaly stated that the rule should be released in Late December 2020, and it appears they are on track to meet that timeline. This means we are currently planning to file our 30 page appeal by the end of February, 2020 (no later than 60 days from the release of the appeal).
December 2nd 2020 - RDQ has meeting with FAA and OIRA to request the FAA fix numerous regulatory issues with the rulemaking process Link: https://www.reginfo.gov/public/do/viewEO12866Meeting?viewRule=true&rin=2120-AL31&meetingId=6327&acronym=2120-DOT/FAA
December 10th 2020 - FAA deletes "Model Aircraft" language from Part 101 - Link: https://public-inspection.federalregister.gov/2020-26726.pdf?fbclid=IwAR3ZW3pHPv_GoSxRMjG7YidxfF_pHaxWlYzbYSzX1BwujbpSyeHPhfIu1yE
December 23rd 2020 - OIRA concludes review of the rule. If the OIRA approved it as written, which is what we assume has taken place, then release of the rule is likely within a couple weeks.
December 27th 2020 - FAA releases draft of the Remote ID rule
December 31st 2020 - RDQ reviews rule and determines there is still ample legal precedent and justification to continue case
Jan 10th 2021 - The following companies have donate funds and give support towards the case against RemoteID: MultiGP, Auline, BetaFPV, CNHL, GNB, Happymodel, HQProp, PandaRC and Vifly
March 12th 2021 - The court case against the FAA has officially been filed and is underway.
