#SilentSham: Legal Defense vs NC Neo-Confederates

We are launching a litigation fund to fight back against the North Carolina Division Sons of Confederate Veterans and their "Commander," R. Kevin Stone!

If you're not already familiar with the SilentSham scandal , the SCV filed a lawsuit against the University of North Carolina over ownership of the "Silent Sam" Confederate monument.  But the lawsuit was bogus – the Sons had conspired with the University on an underhanded, secret deal where the lawsuit was filed, served, answered, and settled in just 7 minutes. As part of the settlement the Sons got to keep the statue, but also got a bonus payment of $2,500,00.00  for a new Klubhouse, and we found out three weeks later that the University gave the SCV another $74,999.00  to do whatever they want!

After this scandal became public, an anonymous member of the SCV sent me an email that showed how crooked the deal was; it was a message from R. Kevin Stone himself, admitting that the neo-Confederates knew they had no basis to sue the University!

I published the letter on my Dropbox account, and then shared it on Twitter. But within an hour of it going public, I was notified by Dropbox that the Sons of Confederate Veterans had filed a bumptious copyright claim  under the DMCA – a complaint filed even though me sharing the letter was classic fair use protected by both copyright law and the First Amendment to the Constitution of the United States.

So we sent them a letter giving the SCV an opportunity to avoid hostilities.

They declined to accept our terms.

So now we're in court against them.

Our objective here is stop this sort of censorship, where beneficiaries of a corrupt bargain can then abuse federal law to silence the people speaking out against them. We also want to protect everyone's freedom to expose this sort of crooked government dealing!

Why is $74,999 our target? Because that's the amount UNC's Board of Governors gave the SCV in "bonus" unrestricted funds last month alongside the $2.5M trust fund. We reckon the SCV will use that money to hire one of the best attorneys California has, and we want to keep a level playing field.

If you support our objectives of rolling back DMCA censorship and protecting the right to expose Government misconduct – or if you just want to watch the Confederacy lose again – we would appreciate your donations! Given what we've got planned, it's unlikely there will be anything left over – but if there is, all additional proceeds will go to the DTH Media Corporation, the 501
(c)(3) entity that publishes the Daily Tar Heel student newspaper at UNC Chapel Hill.
