Stand Against Injustice: Aid for Legal Battle

On Wednesday, June 5, 2024, I was working a Workers Compensation case near Hillard Florida. During the day’s activities, the subject drove to a local church where she and a few juveniles entered the church out of view. While inside the church, I maintained a stationary surveillance position across the street at a Winn Dixie grocery store. After a period of time, the subject as well as various others exited the church and proceeded to conducted festive activities outside the main building in a large open area with an outbuilding and a play area. Due to the geographical layout of the area, I elected to move from the distant stationary surveillance to one of a closer nature. Accordingly, I moved across the street to the church parking lot where I assumed a stationary surveillance position and continued my documentation of the subject who was an ADULT female. During my time in the church parking lot, someone had become suspicious of my presence. I believe this was due to the fact that I was using a secondary surveillance vehicle (my sons car) which did not have heavily tinted windows preventing the Investigator from being observed from outside observers. I was approached by an unknown person who inquired as to my presence to which I indicated that I was waiting for a friend to show up to meet me and this is where he asked to meet. The person then asked if I had any kids present at the event to which I stated no and reiterated that I was waiting for a friend. The person indicated that they had lots of kids playing in the area and given that I wasn’t there for the event, to please go across the street to Winn Dixie and wait. I apologized to the man and immediately departed the area and drove across the street to Winn Dixie parking lot to continue my investigation and documentation of the subject.

Approximately 10 to 15 minutes later and between the approximate hours of 10:35 a.m. 11:10 a.m. the following events occurred. The Nassau County Sheriff’s Department Officers started to arrive in various vehicles. The first deputy to arrive was Deputy Gray who made immediate contact with me. His first words were to the effect that he got a call that I was filming children. I immediately stated that I was working and that I WAS NOT watching/filming children. I then handed Deputy Gray my Florida Investigators license. Mr. Gray then asked for my driver’s license to which I replied that he had my Investigators license and that was sufficient. He then asked me who I was watching to which I responded that I could not divulge that information. It is my opinion that response is what caused Deputy Gray to act in the following described manner. Within 3 minutes of Deputy Gray’s arrival, 3 more marked units arrived. Over the next approximately ½ an hour, I was detained against my will. During this time, I repeatedly stated that I was a licensed investigator and working a case which did NOT involve filming children. I asked several times for the reason that I was being detained to which I was told it was for trespassing. He then ordered Deputy Jones to go and speak with the store manager to get me trespassed from the Winn Dixie property. I heard this and directly stated to Deputy Jones that it was improper of him to “solicit” a trespass. When I confronted Deputy Gray with how the law reads in respect to trespassing and how a person much be first asked by a representative of the property to leave before any action can be taken. Deputy Gray “waved” me off ignoring me. When Deputy Jones returned from soliciting the trespass, I asked him directly what he said /asked the manager to get me trespassed. Deputy Jones responded that all he stated was that I was illegally parked (not true) on the property, and did they want me trespassed to which the manager said yes. I then asked him if that was ALL he said to which he replied yes. Once Deputy Jones returned from soliciting the trespass, I was detained for several more minutes during which time I continued to voice the frustration of being illegally detained. I repeatedly asked all deputies if their body worn cameras were on to which they all confirmed that they were. I also asked for a supervisor to respond to the scene. I continued to be detained against my will and eventually the supervisor, Deputy Unknown Name or Badge number arrived. He walked to Deputy Gray and spoke for a few moments then started to walk away at which point I asked why I was being detained against my will to which the supervisor stated that I wasn’t being detained. I stated that I was not free to go to which the supervisor replied “…alright leave, get out of here, you’ve been trespassed from Winn Dixie…” I then asked the supervisor if he wanted to hear about how my rights were violated by the deputies to which he replied, “…you had your chance to leave, now you’re detaining me, you need to leave…” I immediately turned around and departed the area. I drove across the parking lot to a neighboring Wendy’s where I continued my investigation.

The above is a general description of the events as they occurred. There are numerous issues in the details that have not been conveyed that I feel are very important. I am going to list them here in a non-sequential order.

1) I presented my Florida Investigators license (C9900482) within 15 seconds of the first contact with Deputy Gray. The identification has a direct contact number printed on the rear of it to contact the regulatory department. There is also a government website that my license can be searched REAL TIME within minutes. It is my understanding that at no point and time did ANYONE try to verify my license. My Investigators license was passed from Deputy Gray to Deputy Allen a few minutes after first contact. Deputy Allen maintained possession of my license for pretty much the remainder of the detainment and until he passed it back to Deputy Gray who then continued to complain that my investigators license was not a valid Florida ID.

2) Deputy Jones was directly told prior to soliciting the trespass that he was not allowed to do so. Then he went and LIED to the manager stating that I was claiming to be a license Private Investigator; however, they checked, and I was lying. He repeatedly stated that I was filming kids to which he ALREADY knew was false. He then LIED directly to me when I asked him what he said to management to get me trespassed. It is important to note this. Deputy Jones knew he had lied as indicated by his response when asked what he said. He started to say h told them I was filming kids, but at the very last second, he stopped at the word filming…..leaving a hanging sentence. Please refer to the video for details.

3) Early in the activity, both Deputy Gray and Deputy Allen are speaking and they both state that I was doing nothing wrong, and they couldn’t just trespass me from Winn Dixie without a complaint.

4) When the supervisor arrived, who by the way was the only deputy to NOT have a body worn camera, he exited the vehicle saying “…wish they didn’t have those cameras” to the complainant from the church. The supervisor said the statement TWICE in a row. The audio and video were captured by Deputy Revels body camera.

5) The supervisor was caught on body camera making the statement that he was going to see what he could do…. He then walked away from the body camera cutting off the rest of his statement. The concerning part was that the statement was in response to Deputy Jones saying that I was going to be a problem. I am very concerned about that statement as the state of Florida has tried to come after my license before due to LYING cops. I was vindicated in that matter.

All the funds will be used directly to support the lawsuit against NCSO. I will be providing a detailed report of all funds spent each month as an update.
