Stop Stewart Hill Industrial Park; APPEAL

SHIP Files Appeal!  We Must Defend.

 On March 10, 2020 the New York State Supreme Court ruled that the Town of New Windsor Planning Board exceeded its authority by approving the plans to develop Stewart Hill Industrial Park (SHIP).  The Approval was vacated by the Court because the design (of SHIP) is not permitted under New Windsor Zoning Code for Office & Light Industrial.  In order to achieve this ruling, we gathered collectively to bring this case to the Supreme Court, and WON!  We had over 120 donations and are grateful for each and every one.  We want to sincerely thank all of you who donated to the cause.

Unfortunately, our fight against SHIP is far from over.  In the middle of April 2020 a revised set of plans for SHIP was submitted to the Code Enforcement Officer of the Town of New Windsor.  The revised plans increased the amount of office space slightly.  Stewart Hill LLC (an entity owned by Ziggy Brach, which has an option to buy the land) then applied to the New Windsor Town Board for relief from the building moratorium.  A Public hearing was granted and held on Sept 2, 2020; the Town Board denied SHIP’s relief request at it’s meeting on October 7, 2020.  What is clear is that once the moratorium ends the revised plans will be before the Planning Board. 

On behalf of Rock Tavern United, we are again appealing to our neighbors (and anyone else) to donate to our GoFundMe page today because Stewart Hill LLC, Henry Van Leuween and the Estate of Lester Clark, on Sept 30, 2020, formally appealed the NYS Supreme Court decision to the Appellate Division.  THIS MEANS IT IS TIME ONCE AGAIN TO ENTER THE FRAY AND FIGHT TO DEFEND OUR CASE, AND FINALLY DEFEAT THIS PROJECT !! 

We are the neighbors who live in the area surrounding the property.  We have yards, and gardens; and some of us have kids, and pools, and patios, and dogs.  We live in an area of town where there are only houses, agriculture, and open spaces.  Perhaps like you, we have worked very hard for many years to pay our bills and gain equity in our homes.  Maybe you agree, that wealthy outside interests should not be able to use their influence to buy their way past the Planning Board.  The NYS Supreme Court agreed with this, and ruled as such.  But now those same wealthy outside interests are trying to overturn that ruling, just because they have deeper pockets than we do.  So, we appeal to you to help, by donating to defeat those wealthy outside interests, and save the neighborhood.     

Why do we need to fight this appeal?  If we don’t contest the appeal, or if we lose the appeal, the lower court decision will be reversed and the original SHIP project will be able to proceed.  What does this means for the western part of New Windsor?

·       Increased heavy truck traffic and automobile traffic with the accompanying noise, bright lights and air pollution daily, including nights and weekends.

·       Storm water runoff from the SHIP site and leachate from the SHIP septic system polluting the surrounding wetlands and the stream that originates on the SHIP site and flows through the Brittany Terrace Pond and into Beaver Dam Lake.

·       An estimated reduction of between ten and thirty percent to residential property values in the surrounding neighborhood.

·       It sets precedent for an interpretation of town zoning that opens the door to other large commercial projects of this type.

Our attorney, Michael Sussman, Esq. wants to represent us once again and given the outstanding effort he put forth on our behalf we want to hire him again.  THE APPEAL IS GOING TO COST $7,500.  Mr. Sussman has 30 days to file our response to the Appeal.  We urgently need to raise enough money once again to fight this Project.  Please donate NOW and tell your friends and neighbor of our fight.  Please step up, time is of the essence.

Withdrawal Process

We have the same withdrawal process as we had with our previous GoFundMe campaign.  Rock Tavern United (RTU) is not a formal organization; we do not have an EIN.  It would simply take too long to process the paperwork with New York State and we need to raise the money and pay the attorney ASAP.  The volunteers of RTU have opened a bank account with Hudson Financial Credit Union in Washingtonville, NY.  It is a personal, joint account under the names of myself (William McCracken) and William Istone, a fellow RTU volunteer who lives on Toleman Road in Rock Tavern.  The funds raised here will be transferred to the joint account at Hudson Heritage and then we will get a bank check to pay our attorney.  If there are any questions I can be reached at [email redacted],com
