STRANGULATION Victim's Legal Advocacy

Hi, my name is Devin and on April 28, 2022, I was strangled in my home by a non-romantic tenant whom, in a gesture of goodwill, I allowed to stay in my home for no money, for an agreed-upon (signed contract) period of time.

 

My brother saved me, fought off my assailant and the assailant's friend, and got me and himself to safety, shouting for someone to call the police, who arrived shortly after.

 

Strangulation laws in CO were updated in 2016, lessening the burden on prosecutors to pursue strangulation, which has become recognized as felony assault.

 

Eagle PD had not been updated on the revised statutes, and charged my strangler with misdemeanor assault, and did not book him into jail. I was not awarded an automatic order of protection, and my brother's case for affirmative defense is greatly impeded by not charging my strangler with the appropriate felony.

 

I have sent statutes and case law to the PD and DA, but they're covering their butts and won't increase the charges. STANGULATION is a FELONY!!

 

I have a wonderful victim's advocate who is going to file a motion to prosecute due to prosecutorial capriciousness, and we have to move quickly as my assailant's arraignment is July 13, 2022.

 

But I do not have the liquid funds to pay my advocate, and the clock is ticking.
