Help Us Fight for My Son's Well-Being and Justice

I am a single mother fighting desperately for my son’s safety, protection, well-being and for justice. My son’s grandmother and I have been fighting for my son’s protection and best interest, relentlessly, for the past ten years. (The 3 years we had 'off' were during Covid.)

The first battle we endured was 2014-2019 where we won full protections for my son in 2019, with limited, supervised visitation due to safety and other concerns with his father. My son thrived under those orders, with full safety and protection.

Since 2022, we have suffered through and endured another legal battle, again, fighting to protect my son’s safety, health and well-being. My son’s father filed in a court in his home state different than the court that issued our Final Order in 2019.

(My son was not born in the state where Father lives and my son only lived there for 3 years 2016-2019 before moving back to Ohio, his birthplace, in 2019. Since 2019, my son only spent 4 hours, between 2019-2023, in the state where Father lives so my thriving son has no friends or activities or interests there. In addition, the father is not permitted to drive my son so my son spends a lot of his time with nothing to do when he is there. We had not lived in the state for over 3 years when the father filed in the court.)

This court, where the dad’s friends work for the court system, radically changed our 2019 Final Orders with no concern for my son’s safety or welfare.

This most recent legal matter has been horrendously unjust.

The out-of-state court has terminated all child support from my son while the father, who does not work, continues to afford expensive monthly airfare for my son without having to show any of his financial information to the court. (I was required to turn over all financial documentation and, thus far, he was not held to the same court-ordered requirements of the law.)

All the protections we had for my son were stripped away and my son has been suffering greatly with these changed orders. Just because you see smiles in pictures or on facebook, what we know is that a smile does not mean that a person isn’t struggling.

My son has never had any emotional struggles in life and now is suffering from health issues and serious distress with these changed orders. He is missing school (and has never previously missed excessive school), as he struggles to endure spending approximately 17 hours door-to-door, on his long weekend every month traveling 2400 miles, roundtrip, to another state by himself. This summer he will spend 42 days away from his home if the court does not intervene to protect my son's best interest. Despite my son repeatedly saying to his therapist and the court this is not what he wants, the court did not listen to him. When a child is asked what their preferences are and the court does not listen to the 12-year-old child, it can be considered abuse of discretion. I am fighting to give my son a voice to be heard so his precious life does not continue to suffer, and he can thrive the way he deserves to...

Most recently, as of March 2025, the Father purchased an airline ticket for my son yet didn’t know my son’s correct flight information. My 12-year-old son was left stranded, with a gate agent at a busy airport in another state, for an over an hour, until his dad finally learned the correct flight information and arrived to pick him up. This was incredibly distressing for my son.

This past trip where my son was made to travel against his will, I had to first consult with his pediatrician just before the trip because I could not, in good faith, trust my son would be safe without his pediatrician being a witness and having oversight with what is happening.

My son’s doctor has been treating him since 2021, prior to this legal battle ensuing. She has been aware of this legal battle for the past three years and states she sees the problems it is causing for my son.

My son’s doctor is willing to testify on my son’s behalf, but we must get to the point where we have due process and can be heard. I am doing everything I can to attempt to have the court in my state take jurisdiction during this long appeal process but there are no guarantees. As of now, I have no place to be heard and no jurisdiction that cares about urgently protecting my son’s safety and welfare during this critical time, unless my state’s court intervenes. I have not ever tried to interfere with my son's dad or his dad's family seeing my son and have always complied with the court's orders. But, I have continuously strived to ensure my son's necessary best interest, safety and well-being are protected.

My son loves baseball, and he is currently first in his batting average on his team, a great accomplishment since starting baseball at age of 6. He longed to play in his playoff baseball game but was given no choice, by his father, and was made to travel out-of-state and miss his playoff game with his team. This was incredibly upsetting to my son despite his efforts to ask if the schedule could please be changed. But, it was not, and he missed his playoff game.

On March 20, 2025, I filed an appeal in the father's state. But the appeal could take as long as 9 months, and it requires endless effort and fighting on my part spending weekends and holidays tirelessly writing legal documents. It has been confirmed my due process was violated in this out-of-state court and I have been repeatedly denied the right to be heard to fight for my son’s safety and protection. When a person’s due process is violated, their welfare inevitably becomes destroyed. No matter how hard I work, I cannot build security where injustice exists.

I have tried endlessly to bring this case to our home state but have not been successful yet. Since July 2024, when I became pro se, I have written approximately 3000 pages of legal documents filed into two courts in two different states fighting for my son’s safety, health, protection and best interest. I am not entitled to free legal aid in this out-of-state court, (yet another deprivation of rights that contributes to the destruction of welfare), and any funds I am able to raise need to go toward legal representation for this urgent and critical appeal.

I must keep fighting. But, this fight has taken a devastating toll on my family and I, both emotionally and financially.

(Additional Note: While many other concerning events have transpired over the past 12 years, that resulted in the 2019 court ordering total protections for my son, it is best for the appeal to direct what public knowledge of that information should be. This is a very real matter that needs to be taken seriously regarding my son's well-being.
