I want to begin by expressing my immense gratitude for considering my case and potentially offering your help. Here’s a brief overview of my ongoing dispute to provide a clearer picture of my situation.
In 2018, early in my music career, I signed a contract with Tucxone Records, which has since become a nightmare. Like many beginners in the industry, I didn’t consult a lawyer at the time. The contract was for two albums. Upon completing the second album, conflicts arose when I started asking financial questions about the project and the contract terms. Despite achieving the best album of the year in 2018 and performing around 70 concerts, I have received no remuneration. The situation became tense when I asked for detailed accounts of production costs and financial statements, which were supposed to be provided twice a year per the contract.
The conflict between Tucxone’s partners, Genesis and Tuco, escalated. While Genesis tried to cooperate, Tuco was unresponsive and hostile. Tuco wanted me to start a new project after the second album, but I refused due to unresolved financial issues and lack of clarity regarding my remuneration and rights. Despite assurances of a €40,000 production cost, I received no receipts or statements.
Genesis, worried about his investments in Tucxone, suggested transferring the catalog to another label to avoid wasting the material. Lovemonk then entered the scene with promises of support and growth, but these turned out to be empty promises. Despite my significant contributions, including co-writing and improving most compositions in the first album, I have not been properly remunerated. Borja (Lovemonk) acquired 8 catalogs from Tucxone for €16,000 (€2,000 per artist, both Masters and Publishing). Despite insinuations of costs to be recouped from the previous label, I have it on record that Borja inherited no such costs.
For the past four years with Lovemonk, their minimal investment has left us to rely on our own efforts, such as touring and collaborations, without clear financial statements or answers regarding cost recovery and remuneration. My attempts to amend the unfair contract have dragged on for almost four years, with Borja refusing to make changes unless I commit to new recordings.
Reading the contract with the help of potential lawyers from Elzaburu (Jesús Nogués Cepero, Abogado / Lawyer, Media & Entertainment, Paseo de la Castellana, 259C, Torre Cristal - Planta 28, 28046 Madrid, España, +[34] 91 [phone redacted]), I have understood that we have a chance to break this contract and gain full control of my Masters and Publishing rights. We have been touring since February 2018, and it is disheartening to see our project at risk due to the actions of financial speculators. My loyal team of 12 people and I have sacrificed much, including touring during the COVID-19 pandemic and foregoing other paid work to invest in this project.
I have tried to settle things amicably with Borja, but my offer was dismissed.
I am reaching out to you for help, and it would be very much appreciated. I have my lawyers ready to take on this battle, but I have realized I can’t do it all. I definitely need YOUR help—every possible help you can give. Music has become my lifesaver, and I would be eternally grateful for this second chance. We need to regain control of the assets (Masters and Publishing) so my team and I can continue the work we have dedicated ourselves to for almost eight years now. The music industry is changing, and we need control of our creations to move forward.
