The Township of Wainfleet’s short-term rental (STR) bylaw, coupled with its misuse of Administrative Monetary Penalties (AMPs), is trampling on the rights and freedoms of homeowners and small business owners across our community. This isn’t just about regulating rentals; it’s about the unlawful imposition of escalating fines that leave residents with no recourse. The AMP system, originally designed to handle minor infractions like parking tickets, is being misapplied here, with fines reaching tens of thousands of dollars. This sets a dangerous precedent for other municipalities and endangers fundamental property rights and civil liberties.
The Urgency of Our Fight
This bylaw’s enforcement, along with the AMP misuse, has made it nearly impossible for many in Wainfleet to keep their homes or sustain their businesses. These actions reach far beyond our township, creating a precedent that could affect property rights across Canada. Small businesses that rely on STR tourism—cleaners, landscapers, contractors, and more—are losing their income. And with real estate values dropping by over 30%, Wainfleet families are left unable to sell their homes, trapped in a cycle of escalating fees and property value loss.
