To immediately replace and build a proper horse shelter to protect the horses from the harsh mountaintop elements in Arizona and help Nicky fight this horrific legal battle. Nicky Nelson is fighting this diabolical company, which is trying now to get tens of thousands of dollars and potentially go after her home, in a court battle she is fighting, on her own, right now... still no hearing! She needs full legal counsel to help survive what could be a long court fight. I have been talking to her and have seen some of the documents, and it is just incredible what is happening.

A friend of mine and her horses urgently need your help. I’ve known Nicky Nelson for many years and she was and is a tireless volunteer in Ron Paul type Freedom movements, in spite of her many medical issues.
Nicky bought a little mountaintop property in Arizona to be a home for her daughter’s horse, Madagascar. Her daughter had rehabilitated Madagascar for 3 years following 3 injuries before she bought him. They call it Madagascar mountain. Next, she bought a shelter for Madagascar, and eventually a companion girl horse (who was a rescue) named Stormy.

Her daughter, now 14, originally nursed Madagascar back to health, and now takes care of both horses, Madagascar and Stormy on Madagascar Mountain.



Nicky paid a total, with tax and delivery of around $4,200 for a modest horse shelter based on an agreed upon written quote of $3,200 from the vendor, who at that time, she thought was a normal, honest business man.

Next, Nicky was shocked to find out that the company she bought the horse shelter from was run by apparent dishonest vultures, as they had switched the contract and price to nearly $9,000!!!

Nicky reported these crooks to the Attorney General's office and dispute resolution was initiated. During dispute resolution, Nicky requested evidence from this company and instead of responding, they filed a lawsuit against her, submitting fraudulent documents to the court.

Based on these fraudulent court documents, the judge ordered armed deputies from the sheriff's dept to break into her property and confiscate the, already paid for, horse shelter without Notice and Hearing (Nicky had no idea a court case was even initiated). After Deputies gained access to Nicky's property, Nicky refused to open her locked gate and allow the Company's goon squad to enter. After the Sheriff's dept realized that she had reported them to the AG's office and spoke to the AG's office the Sheriff, realizing she had not had her day in court, left.

Nicky deals with medical problems and was very sick at the time. Once she gained access to court records online, she contacted this company's attorney. He submitted what they were willing to settle for to drop the suit and allow her to keep the horse shelter.

They wanted nearly $10,000 !!! In addition to the already $4,200 she paid, so nearly $14,000 for a $3,200 shelter!

In the court documents, the company wanted to make an example out of Nicky and teach her a lesson and "punish" her by seeking punitive damages also, which could amount to another $50,000 on top of the other costs.... this does not even include what she needs to pay for proper legal counsel to defend against this madness.  (I believe they are trying to punish Nicky to prevent this case from growing into a class action because I believe they are probably doing this to other people in Arizona)

The judge then amended his orders to include arresting Nicky if she did not comply with the Sheriff's department. The Deputy was nice enough to let her know that he didn't want to have to subject her to jail food and a strip search!

They took the above horse shelter that was going to be roofed and turned into a horse barn. Those are heat lamps over Stormy and Madagascar had his blanket on. Stormy would not allow a blanket as she was still wild and in the middle of training. Now the horses don't even have that for the coming harsh rain and electrical storms during monsoon season coming next month and the Arizona summer heat on its way.


NO DUE PROCESS, NO RIGHTS, WHICH ARE GUARANTEED UNDER THE U.S. CONSTITUTION. 




This company basically pulled a “bait and switch” in the contract with fine print on the last page in an addendum.

Nicky and her family have rigged up a shelter the best they could, but are in desperate need to replace the shelter to protect the horses from the harsh elements on the mountain top.

If adequate funds cannot be raised for a proper shelter, there is one she can use for the time being and until she gets back on her feet; see below.



Again, the Judge ordered the armed Sheriffs to seize the paid for horse shelter without a court hearing. Incredible!

Nicky was not given proper notice, and no court hearing to this day. This is the type of judicial tyranny the Founding Fathers were trying to get away from when they founded this country in 1776. –

And now I find out this grabbing property from everyday people is happening all over the country. Most people can’t afford an attorney, don’t know how to defend themselves in court, and give up.

Not only does my friend Nicky need your help to get adequate shelter for the horses as soon as possible, but she also needs funds to get legal counsel to assist her in fighting these businessmen -- who are trying to get tens of thousands of dollars in hopes of putting a lien on her property and potentially forcing the sale of her home if they can.

The main problem is that the Judge has so far done whatever the businessmen want, without giving Nicky a day in court, or responding properly to her very detailed and evidenced court filings.

Many Judges are doing this all over America, and they must be exposed and stopped. So Nicky is not only desperately fighting for her rights against overwhelming odds, but she’s fighting for all of us, because if this is happening to her, it could happen to anyone. In the meantime, the poor horses are caught in the crossfire.



So do what you can today to help Nicky give these horses proper shelter from the coming monsoon season and Arizona heat as quickly as possible, AND to get the money to help her win this legal case, which looks like it will be a long tough battle.

Fighting the corrupted system in court is VERY EXPENSIVE.  She has contacted nearly 20 attorneys and due to the complexity of the case since everything has been outside of the constitution and the norm and the cart has been put before the horse, attorney fees for the cost to fight this case are estimated to be between $15,000 - $25,000 !!! This, in addition to replacing the horse shelter.

If she loses this battle, she could also be on the line for tens of thousands of additional dollars, SO LET'S HELP HER WIN THIS BATTLE!

Keeping in mind that Nicky had paid for her horse shelter in full according to the written quote, the following excellent report is from the website, Nerdwallet.com about a months-long investigation by the Texas Tribune:

Title: “Rent to Own Slip-up Can Land you in Jail”

Here’s part of the article:

“Rental companies can avail themselves of a little-known state law written decades ago by the rental industry lobby — in Texas and in many other states — that can turn a dispute over a loveseat or big screen TV into a criminal offense report, a trip to jail and even felony theft charges.

“A months-long investigation by The Texas Tribune and NerdWallet found rent-to-own companies have pursued charges against thousands of customers in Texas and other states.

“Policies and record-keeping vary wildly even county to county, so it’s impossible to say for sure how many have been arrested.

“But in a single county in central Texas — McLennan, where Waco is located — at least six rent-to-own companies pursued charges against more than 400 customers in the last 3½ years, police offense reports show.”

“ ‘It’s just debt collection by the police,’ said attorney Jonathan Sibley, whose firm has represented defendants who fall into the crosshairs of rent-to-own stores in Waco. ‘Other companies can’t call and threaten prosecution to collect a debt.’

“In Bellmead, adjacent to Waco, the volume of rent-to-own cases was so high earlier this year that the police department assigned an investigator to them to take the pressure off uniformed officers, department spokesman Sgt. Kory Martin said.

“More than 70% of those complaints since 2014 have come from one store, Advantage Furniture. That’s where Maribel Walker, 36, rented bedroom and living room furniture in April 2015.

“Walker, a single mother, acknowledged that she stopped paying for the furniture after a few months and didn’t return it for more than a year. She said a string of personal calamities overwhelmed her and she forgot to make payments after she put the furniture into storage.

“In February, Walker said she was getting her life back together when she went to get her driver’s license renewed and was promptly arrested on felony theft charges.

“ ‘To be taken away like that,” she said, fighting back tears, ‘I mean, it could have been solved a different way.’

“Perkins, the store manager at Advantage Furniture, said he tried to reach Walker to get a payment or have the goods returned. Walker said she was never contacted after she moved.

“Federal law forbids debt collectors from threatening anyone with jail. But those laws don’t apply to rent-to-own companies. Walker, whose case is still pending, was booked into jail and faces felony prosecution.”

Title: “Prosecutors and Judges Have Brought Back Debtors Prison”

Here are some quotes:

“The ACLU examined over 1,000 cases in 26 states where judges dutifully issued the arrest warrants for failure to appear. In four states where they could receive full data (Maryland, Massachusetts, Nebraska, and Utah), the ACLU found 8,500 arrest warrants in debt-collection cases. The warrants cover every kind of debt: medical bills, student loans, rent payments, homeowners’ association fees, utility bills, repairs, payday loans, gym fees, you name it. The amounts involved in the warrants were as low as $28.

“Among dozens of stories is the case of Gordon Wheeler, a Texan whom US Marshals arrested at his home for failure to appear at a debtor’ exam in 2015. He was recovering from open-heart surgery and couldn’t physically get to the hearing. The judgment concerned a $2,500 student loan debt from 1983, which with interest and fees was now $12,000. Wheeler didn’t have the money, so he went to jail. Other debtors were arrested in front of their children; those hit with warrants included those with disabilities and a woman stricken with Alzheimer’s who died before she could be jailed. The report even found examples of people jailed for debts extinguished in bankruptcy, debts they didn’t owe, or debts they’d already paid off.

“ . . . A medical-debt collector in Idaho obtained 345 arrest warrants and jailed 222 debtors over a six-year period. . . .  

“Jared Kushner’s real-estate business obtained arrest warrants for 105 former tenants since 2013, resulting in 22 debtors’ going to jail. Hundreds of these arrest warrants can be rubber-stamped by judges in a single day. . . .

“The impact doesn’t just include a couple weeks in jail but lost wages, potential lost employment, scrambles for childcare, the burden of a criminal record, and the psychological stress and humiliation of being locked up for being poor.”
